Arnona Reduction: Prolonged Vacancy in Tel Aviv

Reducing the arnona in Tel Aviv requires a specific written request, not a standard national procedure. The three-month count begins when the keys are returned, not when the lease ends. The file must prove total absence of occupancy and consumption, often via an on-site inspection. As an owner living abroad, you must act through a legal representative identified with the municipality.

The status of the vacant property: what the land registry (tabou) says

Before making any request, the administrative status of the property must be clear. The Tel Aviv municipality does not reduce the arnona based solely on the owner’s word. It cross-checks information with the tabou, the land registry, to verify ownership. If the property is still registered as occupied or if a lease is active in local databases, the request will be rejected. You must ensure the lease is definitively closed.

The distinction between pure vacancy and partial vacancy is crucial. If furniture remains in the apartment, or if the tenant left personal effects, the property is not considered vacant for reduction purposes. The municipality requires total absence of habitation. Unlike the US, where some processes are standardized online, each Israeli municipality manages its own forms. There is no national « vacancy declaration. » In Tel Aviv, the municipal taxes department handles the file, with its own proof requirements.

For an owner residing in the United States, this step is the turning point. You cannot simply send an email from New York. The file must be submitted by a physical person present in Israel, or via a precise notarized power of attorney. This representative must be identified in the municipal file. Without this clear identification, exchanges become endless. We recommend verifying that the tabou is up to date and that no vaad bayit (condo fees) debt prevents the processing of the request. The municipality may link the arnona reduction to the settlement of any local arrears.

The three-month threshold: how to calculate it in Tel Aviv

The calculation of the vacancy period is strict and mechanical. The counter does not start on the lease expiration date, but on the day the keys are effectively returned. This is the date the tenant left the premises and handed over possession. If the lease stipulated a departure on June 30, but the tenant stayed until July 5, the count begins on July 5. This date must be attested by a signed document, such as a key handover report or a signed lease termination.

To corroborate this date, the municipality may request consumption records. Water data (provided by Oren) is often used. If consumption drops to zero or an abnormally low level from the presumed departure date, it strengthens the request. Holidays and the Sabbath are not counted in the administrative calculation for opening the file, but continuity of vacancy is required. An interruption, even brief, by a new tenant or temporary occupant, can cancel the reduction benefit for the elapsed period.

In Israel, municipal practice takes precedence over a codified framework. There is no single legal deadline in the civil code for tax reductions. It is a local administrative procedure. In Tel Aviv, tolerance is low. Vacancy must be uninterrupted. If you rent the property again after two months, the request for the prior period may be refused if the municipality considers the vacancy not definitive. Ensure the property remains vacant for at least three full months before submitting the request, or accept that the reduction applies only to the period confirmed later.

The application file: specific supporting documents

The application file is a set of precise documents. Missing a document leads to a return and a new processing delay. Here is the list of essential elements to prepare:

  • A certified copy of the tabou and the deed of sale, proving ownership of the property.
  • Proof of the end of the lease: the terminated contract, signed by the tenant and the guarantor, or a departure certificate signed by both parties.
  • A copy of the owner’s ID (passport) and the teoudat zeout (Israeli ID card) of your legal representative in Israel, if they have one.
  • A sworn declaration certifying that the property is unoccupied, signed by the representative. For a foreign owner, this signature sometimes requires legalization or a recent notarized power of attorney.
  • Electricity and water consumption records for the last few months, showing a drop in usage. The Tel Aviv municipality may require proof of non-consumption of electricity to corroborate vacancy, as a running mazgan or doud shemesh indicates occupancy.

It is common for the municipality to request a copy of the initial lease to verify departure clauses. Do not send unnecessary documents. Excess paperwork can slow down processing. Each document must be in Hebrew or accompanied by a certified translation. We prepare these files by verifying the consistency of dates between the deed of sale, the lease, and the vacancy declaration. Any inconsistency in signature dates can invalidate the request.

The role of the guarantor (arev) and the end of the lease

The end of the lease is not limited to the tenant’s departure. The arev (guarantor) plays a central role in administrative closure. They remain engaged until the property is fully released. Their signature on the termination is the key proof of departure. Without it, the municipality may consider the lease still active, even if the tenant has left. The arev must sign the lease termination document, confirming that the tenant returned the keys and left the apartment.

This signature does not prevent the arnona reduction request. The municipality does not require financial justification from the guarantor. It is only interested in physical vacancy. However, you must retrieve the shtar ’hov (promissory note) or verify its cancellation. If the lease ends without incident, the shtar ’hov must be returned or cancelled. Keeping a note in circulation after the lease ends is a common error. If a dispute arises later, an active shtar ’hov can complicate the situation. We systematically verify the cancellation of this document during lease closure. The inspection procedure: the municipal bedek bayit

The Tel Aviv municipality may send an inspector to verify the property’s condition before granting the reduction. This is not a usage check like in the US, but an administrative verification. The inspector comes to confirm the absence of furniture, personal items, and active equipment. They verify that the mazgan is unplugged or out of service, that the doud shemesh is not heating, and that water and electricity meters are stopped.

Organizing this visit requires precise coordination. You must hand the keys to your local representative, who coordinates with the municipal service to set the appointment. The inspector does not call the owner abroad. They contact the representative listed in the file. Before the visit, the property must be in a secure state: windows closed, mamad locked, access secured. If the property shows signs of recent occupancy (dust, traces of life), the reduction will be refused. We organize this key handover and coordination. To understand how to manage key handover when you are not on site, read our article Tel Aviv: organizing key handover in the owner’s absence. The inspector fills out a report that will be attached to the file. This report is the final proof of vacancy.

Calculating the reduction: method and covered period

The reduction is not automatic. It is calculated retroactively from the third month of vacancy. The first two months are considered a grace period. The municipality does not reduce the arnona for vacancy periods under three months. The formula applied is simple: the monthly arnona amount is multiplied by the number of vacant months beyond the grace period. If the property is vacant for six months, the reduction applies to the last four months.

This reduction applies only to the portion of the arnona linked to habitation. If your property includes commercial space or a separate parking spot, these taxes are not reduced. The arnona is a municipal habitation tax, not a broad property tax. Do not confuse it with vaad bayit (condo fees), which remain due even if the apartment is empty. Vaad bayit covers common area maintenance, security, cold water, etc. They do not depend on occupancy. In the US, property taxes are generally based on value rather than usage, but the logic here is different: the arnona is linked to residential use. If use ceases, the tax can be reduced, but building charges cannot.

Follow-up and common errors

After submitting the file, processing takes time. Do not send aggressive follow-ups. The municipality processes files in order of arrival. A frequent error is requesting the reduction before vacancy is effective. If you submit the request while the tenant is still moving out, the request will be rejected. You must wait for the termination signature and key return. Another error is neglecting to update the tabou. If the property was recently sold or transferred, information must be consistent. We follow each file until the final decision. If the municipality refuses the reduction, we analyze the reason and prepare an appeal if necessary. Refusal may be due to insufficient proof of vacancy or document inconsistencies. It is crucial to keep a copy of all exchanges with the municipality. Step Required Action Responsible Party
1. End of lease Signature of termination by tenant and arev. Return of keys. Owner / Representative
2. File preparation Gathering documents: tabou, deed of sale, vacancy declaration, consumption records. Local Representative
3. Submission Submission of file to the Tel Aviv municipal taxes department. Local Representative
4. Inspection Access for municipal inspector. Verification of absence of furniture and consumption. Municipal Inspector
5. Decision Calculation of retroactive reduction. Notification to owner. Tel Aviv Municipality

Never confuse the arnona and the vaad bayit. The arnona reduction applies only to the habitation tax. Condo fees remain fully due, even if the apartment is empty. Always verify that your representative has signed the lease termination with the arev before submitting the request. The proof is what counts, not the contract date.
