Building Fire Insurance in Herzliya: Tenant’s Personal Policy

Building fire insurance in Herzliya is the responsibility of the vaad bayit, not the individual owner. The tenant’s personal policy covers their contents and liability, but it does not replace structural coverage. In the event of a loss, coordination between the building manager and the building’s insurer takes precedence over the tenant’s actions. GII verifies the existence of a liability insurance policy before handing over the keys, as the absence of this coverage exposes the landlord to repair costs not covered by the collective insurance.

The strict distinction between building insurance and contents insurance

In Israel, the separation between the structure and the contents is absolute. The vaad bayit subscribes to a policy covering the walls, roof, foundations, and common installations. This insurance is mandatory for managing common charges. The tenant, in turn, subscribes to a separate contract for their furniture, appliances, and civil liability. There is no equivalent in Israel to the « all-risk home insurance » often required by landlords in other countries, which would cover the structure on behalf of the owner.

The tenant’s contract systematically excludes damage to the building structure. If an internal leak damages the ceiling of the apartment below, the upper tenant’s insurance may compensate the lower owner for the ceiling repair, but it does not pay for the restoration of the pipes if they belong to the building association. This distinction is a frequent source of confusion for owners accustomed to different systems. In some jurisdictions, the nuance is sometimes blurred in « all-risk » policies. In Israel, the boundary is legal: what is within the walls is covered by the building, while what is within the walls but movable is covered by the tenant.

We verify that the tenant has subscribed to civil liability insurance. This is not an administrative formality. It is the only safety net that exists to cover damages caused by their negligence on the private part of the apartment. Without this policy, the owner must advance the repair costs and then seek reimbursement from the tenant, a long and costly process. The presence of this insurance is a condition for signing the lease in our property management practices.

Checking deductibles and limits in the tenant’s contract

The fact that the tenant has insurance does not guarantee they will be compensated. Israeli policies include high deductibles and specific exclusions. We systematically analyze the non-coverage clauses. A frequent exclusion concerns construction defects or the lack of maintenance for installations. If a loss is caused by the deterioration of the doud shemesh (solar water heater) due to lack of maintenance, the tenant’s insurer may refuse compensation if the tenant cannot prove the equipment was in good condition.

Liability limits vary depending on the cause of the loss. A fire caused by a short circuit in a poorly maintained mazgan (air conditioner) may be excluded from civil liability coverage if the tenant has not provided proof of annual maintenance. To verify the solvency of the tenant’s insurer, we request a copy of the policy. We then verify that the insurer is licensed by the Israeli regulatory authority. An unlicensed insurer will not be recognized in the event of a dispute.

The method is simple:

  1. Request the tenant’s civil liability insurance policy before signing the lease.
  2. Check the expiration date and validity of the contract.
  3. Confirm that the insurer is listed on the list of licensed companies.
  4. Keep a copy of the contract in the tenant’s file.

This verification takes ten minutes. It avoids weeks of negotiations after a loss.

Role of the vaad bayit and management of common losses in Herzliya

The vaad bayit is the legal entity responsible for the building. In the event of a loss affecting the structure, the manager must report the damage to their insurer, regardless of any potential fault by the tenant. The tenant does not have the right to contact the building’s insurer directly to request structural repairs. They must go through the manager.

In Herzliya, coordination between the vaad bayit and the insurer is structured. The manager hires an expert to assess the damage. This expert drafts a report that serves as the basis for compensation. If the tenant refuses to cooperate or to allow access to their apartment for inspection, the manager can have the facts documented by an external professional. This refusal may be interpreted as a fault on the part of the tenant, which complicates their own insurance.

We manage the relationship with the vaad bayit on behalf of the owner. If a loss occurs, we immediately inform the manager. We do not let the tenant act alone. This centralization avoids contradictions in statements. For example, if the tenant reports a leak to their insurer citing an internal cause, while the manager reports a common plumbing issue to their insurer, the two insurers may pass responsibility back and forth. By acting as the single intermediary, we ensure consistency in the statements. For more details on proving fault, see our article on hall damage.

The risk of underinsurance by the tenant and landlord protection

The most frequent type of dispute concerns water leaks. Consider a concrete example: a leak in the tenant’s apartment damages the ceiling of the apartment below, which belongs to another owner. The upper tenant’s insurance must cover the repair of the lower ceiling. But if the tenant does not have civil liability insurance, or if their policy is insufficient, the lower owner suffers the loss.

In this case, the lower owner turns to the owner of the upper apartment. This is where the shtar ‘hov (promissory note) signed upon move-in takes on full meaning. This document is a debt acknowledgment signed by the tenant and their arev (guarantor). It is not an insurance, but it constitutes a payment guarantee. If the repair costs are not covered by insurance, we can demand payment via the shtar ‘hov. The guarantor then becomes responsible for the amount due.

We insist on verifying civil liability before handing over the keys. A tenant without insurance is a major risk. We do not sign a lease without proof of coverage. This requirement is non-negotiable. It protects the owner against the risks of underinsurance. The shtar ‘hov does not replace insurance; it complements it. Insurance covers the loss; the shtar ‘hov covers the default in payment. Both are essential.

Specifics of recent buildings and solar installations

Recent buildings in Herzliya are equipped with solar systems. The question of insuring the doud shemesh is often misunderstood. Solar panels are common installations. They are therefore covered by the vaad bayit‘s insurance. The tenant does not need to insure them. However, the internal pipes that bring hot water into the apartment are the tenant’s responsibility if they are located within the walls of their apartment.

The main risk is overheating or pipe rupture. The distinction between normal wear and accident is crucial. Normal wear is the responsibility of the vaad bayit, as it falls under building maintenance. An accident, caused by tenant negligence (for example, a clog due to an object introduced into the pipes), is their responsibility. To maintain the validity of the vaad bayit‘s insurance, the municipality or the insurer may require proof of annual maintenance of the solar systems.

We ask the tenant to keep maintenance receipts for their internal equipment. In the event of a loss, these documents prove that they fulfilled their obligations. If the doud shemesh is malfunctioning, the tenant must report it to the vaad bayit, not to their own insurer. The repair will be covered by the building association. This distinction avoids disputes over repair billing.

Procedure in case of loss: who calls whom?

The order of operations is strict. In the event of a loss, the tenant must not call the building’s insurer directly. They must inform the vaad bayit and the GII manager. We handle the claim. This centralization is vital. If the tenant calls their insurer and the manager at the same time, the statements may diverge.

The first step is the assessment of the damage. The vaad bayit hires an expert to perform a bedek bayit (building inspection). This expert evaluates the damage to the structure. The tenant must allow access to the premises. If they refuse, we document this refusal. This refusal can be used against them in the event of a dispute.

Documentation is mandatory. We require:

  • Dated photos of the damage, taken immediately after the loss.
  • The intervention report from the fire department or municipal technical services, if applicable.
  • The report from the vaad bayit‘s expert.

These documents are attached to the insurance claim. Without them, compensation may be delayed or refused. We manage this procedure from start to finish. The tenant only needs to report the problem. The rest is our responsibility. This approach avoids procedural errors that are costly.

Tax and accounting impact of premiums and compensations

Insurance premiums paid by the owner for their apartment are deductible from rental income. They are declared to the reshut ha-misim (tax authority) as management expenses. This does not refer to the vaad bayit premium, which is a common charge, but to any additional insurance subscribed by the owner for their personal assets.

Compensations received in the event of a loss must be handled with accounting precision. It is necessary to distinguish the reimbursement of repair costs, which is tax-neutral, from compensation for loss of use. If the apartment is uninhabitable for several months, the compensation for lost rent is taxable. We verify that the tenant has not already declared the loss on their own policy to avoid double compensation. If the tenant has been compensated by their insurer for the loss of their contents, they cannot request additional compensation from the owner for the same items.

Accounting must reflect reality. We maintain a register of losses. Each transaction is tracked. In the event of a tax audit, we provide the supporting documents. This rigor is essential to avoid adjustments. Israeli taxation is complex. A declaration error can cost more than the loss itself. We ensure the compliance of each declaration.
