Early Termination Agreement: Template for Tenants in Israel

In Israel, a tenant cannot unilaterally terminate a fixed-term lease. They remain liable for the full rent until the end of the contract, unless a written agreement states otherwise. Signing an early termination agreement must be formal, include the guarantor, and specify how the remaining debt will be handled.

The Israeli Lease: No Unilateral Termination Clause

Israeli law does not offer specific tenant protections comparable to the French law of 1989. A residential lease is a standard civil contract. Its duration is set at signing. If the tenant leaves the property before the expiration date, they have no legal right to break the lease. They must honor their commitment.

This rigidity protects the owner. The tenant cannot invoke a « legitimate reason » or a change in personal circumstances to escape their obligations. The contractual debt persists until the end date of the lease.

The shtar ‘hov plays a distinct role compared to a bank guarantee. This promissory note, signed by the tenant and their guarantor at the start, guarantees payment. It does not cover the early departure itself, but it secures the collection of rent due for the remaining period. If the tenant leaves, the shtar ‘hov allows the owner to claim the outstanding balance.

In France, the law often imposes a regulated termination procedure. In Israel, the contract rules. If the contract does not provide for an exit clause, there is no exit. The owner must anticipate this risk. We systematically verify the consistency between the lease duration and the strength of the shtar ‘hov before signing. If the tenant wishes to leave, the only solution is negotiating a written agreement that modifies the initial terms. Without this agreement, the debt remains intact.

Negotiating Compensation: Calculating the Remaining Debt

When a tenant announces their departure, the first step is calculating the potential loss. This is not about negotiating an arbitrary amount, but determining the exact debt.

The method is simple:

  1. Calculate the number of months remaining until the end of the lease.
  2. Multiply this number by the monthly rent amount.
  3. Subtract the rent already paid.
  4. Add the costs of finding a new tenant (advertising, viewings).

The arev (guarantor) is the key to this recovery. The guarantor’s commitment is joint and several. This means the owner can pursue them directly for the full amount due, without first having to sue the departed tenant. This is a strong protection, often absent in French leases where the guarantee is limited.

Consider a concrete case: a 24-month lease. The tenant leaves in the 12th month. The theoretical debt is 12 months of rent. If the owner finds a new tenant the following month, the actual loss is zero, but the contractual debt of the former tenant remains. The departure agreement must therefore specify whether this debt is canceled, reduced, or maintained.

We never recommend accepting a simple verbal promise. The calculation must be written. If the owner agrees to reduce the debt, they must obtain a document signed by the tenant and the guarantor waiving the difference. Without this document, the original shtar ‘hov remains enforceable for the full amount.

The « Subletting » Clause: Mitigating Loss Without Canceling the Debt

A common practice in Netanya is the replacement clause. The departing tenant commits to finding a replacement. This clause does not remove the debt; it reduces the risk of vacancy.

The agreement must distinguish between two situations:

  • The tenant finds a replacement: the lease is transferred, or a new lease is signed. The former tenant is released from future debt but remains responsible for months already elapsed and transition costs.
  • The tenant does not find a replacement: they remain liable for the full rent until the end of the original lease, even if the owner finds another tenant on their own.

It is frequent for the tenant to propose paying one month of rent as a « penalty » or cleaning fee. This sum does not cover the remaining debt. It compensates for administrative fees and cleaning. The balance of the debt must be handled separately.

Be aware of a common confusion: the fact that the owner finds a new tenant does not release the former one. The contract binding the former tenant and the guarantor is distinct from the new contract. If the departure agreement does not specify that the debt is extinguished by the relocation, the owner can theoretically claim the rent from the guarantor while also receiving the rent from the new tenant. This is a possible double gain, but it must be explicitly provided for to avoid any dispute.

We draft these agreements to clarify this mechanism. The goal is to secure the owner’s cash flow. If you already have unpaid utility debts, consult our article on Unpaid Utility Debts: Recovering Rent After an Early Departure in Israel to understand the recovery procedure.

Drafting the Departure Agreement: Mandatory Legal Elements

The departure agreement is a contract distinct from the lease. It does not merely note the exit date. It must restructure the financial obligations.

The document must contain:

  • The exact date of key return.
  • The amount of the remaining debt, or a declaration of its nullity.
  • The signature of the tenant, the owner, and the guarantor.
  • An explicit mention of the fate of the shtar ‘hov.

The critical point is the shtar ‘hov. Either the agreement specifies that the original note remains valid for the unpaid balance, or it is replaced by a new shtar ‘hov limited only to the accepted remaining debt. Never return the original without a written counterparty.

Utilities must be handled separately. The arnona (municipal tax) and the vaad bayit (condo fees) are often included in the rent or billed separately. The agreement must indicate who pays these amounts until the departure date. If the tenant leaves mid-month, the proration must be calculated.

We verify that the agreement mentions the management of electricity and water. Are the bills in the name of the owner or the tenant? The transfer must be documented. If the tenant leaves without settling their consumption, the debt is added to the rent.

A poorly drafted agreement creates ambiguities. In Israel, written evidence prevails. We use standard templates that cover these points. Inventory and Return: The Role of the Inspection

In Israel, there is no mandatory « technical inspection » before renting, unlike in France. The inspection is a contractual practice, not a legal obligation.

For an early departure, this inspection is crucial. It serves to distinguish normal wear and tear from damage.

We hire a professional for a building inspection (bedek bayit). This written report lists the condition of the following elements:

  • The mamad (safe room) or the mamak (protected common space): verification of locks and structure.
  • The doud shemesh (solar water heater): check of proper functioning and absence of leaks.
  • The mazgan (air conditioner): test of cooling power and cleanliness of filters.
  • Floors and walls: distinction between light scratches (wear) and holes or stains (damage).

The report is signed by both parties. It serves as evidence in case of dispute. If the tenant disputes a deduction from the security deposit, this document is the proof.

Normal wear (peeling paint, slightly worn carpet) is the owner’s responsibility. Damage (hole in the wall, broken tile) is the tenant’s responsibility. The departure agreement must mention this report. If the tenant refuses to sign, we note this refusal and attach the report to the file.

This step takes one day. It avoids months of procedure. We organize this inspection on the day of key return.

Management of Guarantees and Blocked Funds

The security deposit (often called a « guarantee ») is blocked until all financial points are resolved.

The return procedure is as follows:

  1. Verification of the inventory (see previous section).
  2. Calculation of amounts due by the tenant (remaining rent, damages, cleaning fees).
  3. Deduction of these amounts from the security deposit.
  4. Return of the balance to the tenant.

If the security deposit is insufficient to cover the debt, the owner must claim the difference from the tenant or the guarantor. If the deposit is higher, the balance is returned.

The return is made by bank transfer or check. A receipt is signed.

Major point of vigilance: the shtar ‘hov must not be returned until the debt is extinguished. This note is the guarantee of the debt. Returning it amounts to canceling the debt. If a departure agreement has been signed and the debt is settled, the shtar ‘hov can be destroyed or returned with a receipt.

Also check the electricity and water bills. If the tenant consumed energy after their departure, the bill is due to them. We verify the meter readings before closing the file.

If you manage your property yourself, this procedure can be complex. Our property management in Netanya handles these steps, from inspection to the return of funds, ensuring the compliance of documents.

In Case of Dispute: The Court Procedure

If negotiation fails, the owner can take the matter to court. In Israel, rental disputes fall under district courts or local justice, depending on the amount.

The procedure is written. There is no immediate oral hearing as in France. The parties exchange briefs.

The owner must provide:

  • The original lease.
  • The shtar ‘hov.
  • Proof of early departure (email, letter, bailiff’s report).
  • The detailed calculation of the debt.

The court examines whether the tenant respected the contract. If the shtar ‘hov is valid, the judgment is often favorable to the owner. Executing the judgment can take time. This is why prevention through a good written agreement is preferable.

The cost of a lawyer is high. For a rent debt, the procedure can cost more than the amount due. This is why we favor mediation or direct negotiation.

If the tenant is insolvent, recourse to the guarantor is essential. The court can order the guarantor to pay. If the guarantor refuses, forced execution measures can be taken on their assets.

We advise keeping all written exchanges. In Israel, spoken words do not have strong evidentiary value. The written word prevails.

Summary Table of Responsibilities

Element Tenant Responsibility Owner Responsibility Point of Vigilance
Remaining Rent Due until the end of the lease, unless otherwise agreed Can receive rent from a new tenant Specify in the agreement if the debt is canceled or maintained
Damages At their expense (excluding normal wear) At their expense (normal wear) Signed inspection report (bedek bayit)
Utilities (vaad bayit, arnona) Due until the departure date Due after the departure date Proration of the exit month
Security Deposit Returned after deduction of debts Must return the balance Do not return the shtar ‘hov before debt extinction
Search for Replacement If provided in the contract, at their expense Can search alone, but does not release the former tenant Distinguish the search from the lease transfer

Before signing a departure agreement, have the shtar ‘hov and the debt calculation checked by a professional. A poorly drafted agreement can cause you to lose the right to claim the balance. We manage these steps for you in Netanya.
