Non-Compliant Windows in New Building: Filing a Claim in Israel

Non-compliant mamad glazing that fails to meet thermal or safety standards constitutes a construction defect engaging the developer’s liability. You must have the anomaly documented by an independent professional before initiating any legal proceedings. The procedure relies on a formal written notice and, if an amicable resolution is not reached, on a claim before the competent civil court, without undergoing standard French inspections.

The mamad and the obligation of conformity: what the construction contract says

The mamad is a secure room designed to withstand impacts and intrusions. It is not a simple bedroom, but a compartment whose glazing must meet precise specifications. There is a fundamental distinction between thermal performance and ballistic or anti-intrusion resistance. Glazing can be thermally efficient (insulating double glazing) but not resist a break-in attempt, or vice versa. Your construction contract, signed with the developer, contains a technical appendix detailing the materials used. This is where the glass thickness, the type of treatment (tempered, laminated), and the expected insulation coefficients are listed.

In France, standards are often general. In Israel, specifications are contractual. If the contract mentions security laminated glass for the mamad and the installation reveals only standard double glazing, the developer has failed to meet its obligations. The deed of sale defines conformity. It is not a matter of referring to an abstract national standard, but to what is written in the notarial document. The role of the inspector approved by the developer at the handover of keys is crucial: they verify the presence of elements, but their signature does not validate the intrinsic technical performance of the glass. They document the installation, not the impact resistance. You must therefore read this technical appendix before accepting delivery. If the specifications are vague, the claim will be difficult to formulate.

Key handover: why tolerating non-critical defects blocks the claim

At the handover of keys, the developer presents a list of minor defects, often called a « punch list. » These include scratches, small paint cracks, or poorly installed seals. You sign this document to accept delivery subject to the correction of these points. The trap lies in the wording. If you sign without expressly mentioning the non-compliance of the mamad glazing, you are deemed to have accepted the state of the premises. Israeli case law considers that the signature of this list constitutes acceptance of the elements not reported.

In France, the absence of standard inspections like the state of installations does not prevent the warranty against hidden defects. In Israel, the logic is different: it is the handover that crystallizes rights. Once the keys are handed over and the list is signed without a specific reservation regarding the glazing, the developer can invoke apparent conformity. To preserve your rights, you must write on the defect list, in clear letters, that the mamad glazing does not correspond to the contractual specifications. If the developer refuses to record this, take timestamped photos and send a registered letter the same day. Never let the handover pass without having the technical discrepancy documented. The developer’s liability is limited in time for apparent defects. The longer you delay reporting the anomaly after the handover of keys, the more fragile your position becomes. The difference with the management company is clear: the management company manages the real estate, the developer is responsible for the construction.

Obtaining a technical assessment by an accredited professional

You cannot rely on your own estimate. You must involve an independent professional, distinct from the developer and its subcontractor. This is not a legal obligation, but a probative necessity. What is commonly called a building inspection (bedek bayit) must here be specialized in joinery and security. The expert will measure the actual thickness of the glass, verify the presence of the safety layer (safety interlayer), and test the airtightness of the frame. They will compare their measurements with the contract specifications.

The report must be drafted in a factual manner. It must indicate the date of the intervention, the measuring tools used, the readings taken, and the conclusion: compliant or non-compliant. If the glass is too thin, the report must quantify it. This document will be your main proof in case of dispute. Without it, your claim rests on allegations. In Israel, the burden of proof lies with the claimant. The expert must be chosen with care: avoid those who work exclusively for developers. A neutral expert, referenced by the chamber of engineers or by specialized lawyers, offers increased credibility. The report must be in Hebrew, as it is the language of the court. If you are not bilingual, request a certified translation. The expertise costs money, but it is an investment that secures your case. Do not neglect the verification of the seals: a perfect glazing but poorly sealed offers no real protection.

The procedure for formal notice to the developer and the management company

Once the expert report is in hand, you must formalize your request. The lawyer drafts the formal notice. This letter, called a « letter of demand, » is sent to the developer and, if the building is already delivered, to the condominium reserve fund (vaad bayit). The letter must be precise: it cites the contract, the expert report, and requests the replacement of the glazing or compensation for the damage. It sets a response deadline, generally of two to four weeks.

The choice of recipient depends on the phase. During the developer’s warranty period (which varies according to the contract and the law), they are responsible. After the end of the warranty, liability may shift to the reserve fund, managed by the management company, for elements considered as normal wear or maintenance. But a design or material defect remains a fault of the constructor. The content of the demand must include the justification of costs. You do not ask for « repair, » you ask for replacement with compliant glazing, at the expense of the responsible party. If the developer contests the conformity, they must produce their own proofs. The formal notice is a legal act that interrupts statute of limitations. It obliges the developer to react. If they do not respond, you are in a strong position to bring the case before the court. The management company, for its part, cannot decide alone to pay a bill for the replacement of security glazing; it must follow the procedures of the general assembly.

The role of the insurer and the developer’s civil liability policy

Any serious developer must subscribe to a civil liability insurance covering construction defects. This policy is mandatory to obtain the building permit. In case of claim, the developer is required to declare the incident to its insurer. It is they who make the declaration, not you. Your role is to provide the documents: the contract, the expert report, the formal notice. The developer’s insurer will appoint its own expert to assess the damage. They will seek to minimize the amount of compensation.

The negotiation takes place between insurers or between the developer’s insurer and your lawyer. The insurance broker evaluates the cost of replacement at market price. If the glazing is unobtainable or if the replacement requires a complex intervention, the cost may be higher. The insurer may refuse to cover if the defect is considered as normal wear. This is where the precision of the expert report becomes decisive. If the report proves a manufacturing or specification defect, coverage is more likely. In France, the ten-year liability insurance is well known. In Israel, the mechanism is similar but managed by local companies. You do not have to negotiate directly with the insurer if you have a lawyer. However, you must remain vigilant: the insurer may propose cash compensation rather than replacement. It is up to you to decide if this is acceptable. The goal is to restore a compliant mamad, not to receive a sum of money.

Recourse to the court: the competence of the family or district court

If the formal notice remains without effect, you must bring the case before the justice. The choice of court depends on the amount of the claim. For low-value disputes, the local court (Local Court) is competent. Beyond a certain threshold, which is determined by the current scales, you must bring the case before the district court (District Court). There is no family court for this type of civil dispute; this is a frequent error. The family court handles succession matters or marital conflicts, not commercial real estate disputes.

You must produce all your proofs: the contract, the expert report, the formal notice, the letters, the photos. The file must be in Hebrew. The court may order mediation before the main hearing. This is a mandatory step in many cases. Mediation allows finding an agreement without a trial. If it fails, the case is argued. The judge may order a judicial expertise, which costs more and takes more time. This is why the prior amicable expertise is essential. The court can condemn the developer to the costs of repair and damages. It can also order the termination of the contract if the defect is major, but this is rare for a single glazing. The procedure is long. Count several months, or even years. This is why you must do everything to resolve the dispute amicably. The court is the last resort, not the first reflex.

Compensation and repair: calculation of the damage and impact on the asset value

The damage is calculated in two steps. First, the direct cost of replacement: the price of the compliant glazing, the labor, the travel costs of the team. Then, the indirect damage. If the defect makes the apartment less safe or less comfortable, it can affect its resale value. A future buyer, during their inspection, will detect the anomaly. They may request a price reduction. This loss of value is a reparable damage. You must document this impact. If you wish to buy or sell in Israel, the conformity of security elements is a major negotiation criterion.

The compensation must cover all costs incurred. If you had to pay for temporary accommodation during the works, these costs are claimable. If you lost a tenant because of perceived insecurity, the loss of rent can be included. The calculation must be supported by invoices. The developer or its insurer will refuse unjustified amounts. The impact on the asset value is real. A non-compliant mamad is a red flag in the sales file. It is therefore necessary to insist on physical replacement, not just on money. The replacement restores the value of the property. Cash compensation does not. You remain the owner of a property with a known defect. This complicates the resale and the rental. Physical repair is the only solution that resolves the problem at the root.

Rental management and follow-up after the resolution of the dispute

Once the dispute is settled and the glazing replaced, the management of the property continues. You cannot do everything yourself from France. Who receives the keys for the inspection? Who finds the tenant? Who responds when a pipe bursts on a Friday evening? These are concrete questions that arise from the signature of the deed. Professional rental management takes over. We manage the rental, the selection of tenants, and the follow-up of charges (vaad bayit) and the municipal tax (arnona).

In case of a new breakdown, such as a air conditioning breakdown in a new mamad: who pays in Israel?, we intervene immediately. We know the local suppliers and the repair deadlines. If a leak in the wall of the mamad: owner’s responsibility in Israel occurs, we know who to contact. The remote owner cannot be on site. Rental management ensures the continuity of the service. We negotiate maintenance contracts, we bill the tenants, and we report the rents to you. This is a clear separation of roles: you are the owner, we are the managers. You keep the financial control, we manage the operational side. This avoids unpleasant surprises and unnecessary costs. The claim on the glazing is an incident. Daily management is the norm. You need a local, reactive, and competent interlocutor. This is what we do.

Never sign the defect list at the handover of keys without having the conformity of the mamad glazing documented by a professional. If an anomaly is detected, mention it explicitly on the document and keep a copy. In case of dispute, your file must rest on an independent expertise and a formal notice. For the daily management of your property and the resolution of common incidents, entrust the task to a local professional who knows the repair circuits and legal responsibilities.
