Ongoing Lease Following the Death of a Property Owner in Israel: What to Do

In Israel, the death of a landlord does not interrupt the lease agreement. The lease continues between the tenant and the estate, which becomes the relevant party. You do not need to sign a new lease or renegotiate the terms. Your role is to maintain financial flows (rent, vaad bayit) and secure the property until you obtain the succession order (tsav yerusha) from the family court.

Automatic lease continuity and the legal capacity of the estate

The lease is a contractual link that survives the death of one of the parties. Unlike certain administrative practices in France where a simple death certificate is enough to change the title holder on some registers, Israeli law requires a precise legal structure to act. The estate constitutes a distinct entity, a temporary legal person, which exists between the death and the final distribution of assets. As long as this entity is not dissolved, it holds the rights and obligations of the deceased.

The tenant cannot invoke the death to unilaterally terminate the contract. They must address any requests for modification to the heirs or the estate administrator. If the tenant stops paying by citing the absence of a « living owner, » they commit a contractual breach. The response is simple: you remind them in writing that the lease is still in effect and that the estate is their legal contact.

The key element is the succession order, the tsav yerusha. Without this document issued by the family court, the heirs cannot sell the apartment or transfer the property to the tabou. However, they can collect rents and manage the real estate on a daily basis. This is a crucial distinction: day-to-day management is not blocked by the need to obtain the document. Only the transfer of property is. You can therefore collect rents immediately, without waiting for the judicial procedure, which can take several months.

Managing rents and fund deposits during the transition period

Fund traceability is essential to avoid conflicts between heirs and tax complications. Open a bank account dedicated to the estate or use the deceased’s account if the bank allows it temporarily. Never mix rental income with your personal funds. This separation protects the estate in case of litigation and simplifies the declaration to the reshut ha-misim.

To change the account where the tenant pays, send a written notification by email with a read receipt or by registered mail. Specify the new bank reference and the effective date. The tenant must be clearly informed to avoid disputes over payments made to the wrong place. If the tenant continues to pay into the old account after notification, those funds are owed to the estate.

If rent is paid via a shtar ‘hov (promissory note), these documents remain valid and enforceable against the estate. This is not insurance, but a signed debt acknowledgment by the tenant and their arev (guarantor). These papers constitute proof of the tenant’s debt to the property, not to the deceased person. Keep them carefully. In case of non-payment, you can execute the shtar ‘hov directly, without going through a long judicial rent recovery procedure. This is a powerful tool that many French-speaking owners ignore.

Condominium fees and heir responsibilities

The vaad bayit is a debt of the building, not of the individual. The heirs become jointly liable debtors from the moment of death. The building manager can initiate proceedings against them without waiting for the estate to be liquidated. If the deceased owner had not paid their fees, the estate must regularize the situation quickly.

Check for previous unpaid amounts. The tenant is not responsible for the landlord’s past debts, but they may face service interruptions if the manager acts. Ensure that the lease clearly states who bears the share of the vaad bayit due by the tenant. In Israel, the vaad bayit covers common areas and shared equipment such as the collective doud shemesh (solar water heater).

There is no « condominium bylaw » enforceable against the tenant in the same way as in France. The vaad bayit is managed by the assembly of co-owners. If the tenant reports a problem in the common areas, they must address the manager, not you directly, unless the lease states otherwise. You, as the representative of the estate, must ensure that your share is up to date to prevent the manager from blocking essential services for the apartment.

Apartment maintenance and urgent technical interventions

The distinction between routine maintenance and major repairs is vital. Routine maintenance (cleaning, minor repairs) is the tenant’s responsibility. Major repairs and the replacement of fixed equipment are the responsibility of the estate. In case of a breakdown of the mazgan (air conditioner) or the doud shemesh, you must intervene, as these are elements integrated into the property.

To hire a professional without your physical presence, the estate administrator or a mandated heir can sign the quotes. It is recommended to have the state of the apartment documented by a professional (bedek bayit) if any damage exists. This is not a legal obligation, but a protection against tenant claims. The written report establishes the state of the premises at the time of death and any subsequent interventions.

Managing the mamad (safe room) is a sensitive point. Check the compliance of the reinforced door and the alarm system. If the tenant reports a failure, react quickly. The security of the mamad is a crucial issue in Israel, especially in condominiums. An unaddressed failure can engage the liability of the estate. Do not allow the tenant to intervene alone on the security of the mamad without your written consent.

Taxation: declaration of rental income and obligations to the reshut ha-misim

Rents collected by the estate are taxable. The reshut ha-misim (tax authority) considers these revenues as coming from the estate. You must declare these revenues within the framework of income tax (mas hachnasa). There is no specific regime for estate rental income, but traceability is paramount.

Heirs must ensure that the deceased’s tax declarations were up to date before death. If rents had not been declared, the estate may be held responsible. Keep all payment receipts for rents and maintenance expenses. These documents will serve as proof in case of a tax audit.

Capital gains tax on real estate (mas shevach) does not apply to rental, but it will become relevant if you decide to sell the apartment after the succession. The holding period starts from the date of acquisition by the deceased, not from the date of death. This temporal continuity is important for calculating future tax. Consult an Israeli accountant to structure the declaration.

Communication with the tenant and conflict management

Communication must be formal and written. Avoid untracked oral conversations. All important exchanges (account change, repair request, succession notification) must be done by email with a read receipt or by registered mail. The tenant must know who their legal contact is.

If the tenant disputes the legitimacy of the heirs to manage the lease, provide them with a copy of the tsav yerusha or, in the meantime, a notarized declaration from the heirs. This proof is sufficient to establish your capacity to act. Do not allow the tenant to settle into an ambiguity that could delay payments or repairs.

In case of conflict regarding noise or neighborhood issues, the procedure is the same as usual. The tenant must respect good neighborly rules. If the problem persists, you can take the matter to court or contact the police. The estate does not have a special status that would weaken your position. After signing: who manages the day-to-day?

Once the succession deed is signed, the day-to-day operations must be smooth. Who receives the keys in case of an emergency? Who finds a new tenant if the contract expires? Who responds when a pipe bursts on a Friday evening? These questions cannot remain unanswered.

If you live in the United States, you cannot be on site for every incident. This is where property management comes in. We manage the entire cycle: rent collection, vaad bayit tracking, professional interventions, and communication with the tenant. We ensure service continuity without you having to intervene remotely for every technical detail.
