Rental Agreements in Israel: Essential Documents

A landlord may face a tenant unable to pay monthly rent or disputes regarding the apartment’s condition if the rental file is incomplete. Signing a lease in Israel is not just about agreeing on the rent amount; it relies on a specific collection of legal and administrative documents designed to protect the landlord against insolvency and maintenance issues.

Tenant identification and solvency verification

Selecting a tenant depends on proof of identity and financial capacity. We systematically request the teoudat zeout for Israeli residents. For non-residents or tourists staying for a set period, a passport is the only valid identification document. We verify the validity of the document’s dates to avoid administrative complications when drafting the contract.

The solvency review goes beyond a simple declaration of income. We require recent Israeli bank statements. These documents allow us to observe cash flow and confirm that the tenant has the necessary funds to cover rent and additional charges. For foreign tenants without a local banking history, we request proof of income from abroad, often certified by international account statements.

The presence of a guarantor, known as an arev, is a common practice in Israel to secure the lease. We conduct a review of this guarantor’s financial situation. We request a copy of their teoudat zeout and proof of income. The guarantor must be a person capable of answering for the debt in the event of the primary tenant’s default. We ensure the link between the tenant and the guarantor is clearly established in the lease to make the commitment enforceable.

Securing the debt through the shtar ’hov

Unlike some practices in the US or UK that rely on large security deposits, Israeli law frequently utilizes the shtar ’hov. This is a promissory note, a recognition of debt signed by the tenant and their guarantor. This document does not involve an immediate cash payment upon signing. It constitutes a debt instrument that allows the landlord to initiate faster recovery procedures in case of non-payment.

We strictly distinguish the shtar ’hov from the security deposit. The former serves to cover unpaid rent and significant damages, while the latter, if it exists, is a sum held for restoration costs. Using a shtar ’hov protects the landlord against the exhaustion of the deposit in the event of several months of unpaid rent. We draft this document so that it is legally independent of the lease agreement, which facilitates its execution in court.

The signing process for the promissory note generally takes place at the time of key handover. We ensure that every signatory, both tenant and guarantor, signs the original document. This step is crucial to ensure protection is effective from the first day of occupancy. If you delegate this part to our property management services, we coordinate the collection and verification of these signatures.

Documents related to charges and municipal tax

Managing additional charges requires precise traceability to prevent debts from falling back on the landlord. The tenant must provide proof of payment for the arnona for the current year or, failing that, a certificate of regularity from the municipality. The arnona is a municipal residential tax often linked to the owner’s account; a tenant’s failure to pay can therefore directly impact your financial situation.

Building management fees, or vaad bayit, must also be monitored. We request the transmission of the latest vaad bayit payment notices to ensure no arrears are passed on to the new tenant. A tenant moving into an apartment with outstanding building debts creates immediate conflict with the building management.

Once the lease is signed, updating the name of the liable party with the municipality is a mandatory administrative step. We carry out this process to transfer the responsibility for the arnona from the owner to the tenant. This prevents the municipality from claiming unpaid amounts from the landlord due to a failure to update municipal records.

Document Utility for the landlord Required action
teoudat zeout Legal identification of the tenant Certified copy
Bank statements Proof of payment capacity Verification of monthly flows
shtar ’hov Recovery of unpaid rent Signature of guarantor and tenant
arnona certificate Avoid municipal debts Verification of no arrears

Inventory of fixtures and mandatory technical equipment

The move-in inspection must be documented with precise records to avoid disputes when the tenant moves out. We record water and electricity meter readings to facilitate the transfer of responsibility with the utility providers. This reading must be recorded in writing and signed by both parties to mark the exact date the tenant’s consumption begins.

In Israel, certain equipment is structural and requires particular attention upon move-in. We check the operating condition of the mazgan (air conditioner) and the doud shemesh (solar water heater). The doud shemesh is a standard element of Israeli housing; a malfunction in this system immediately impacts the tenant’s ability to use hot water. We verify that this equipment is in working order and document its visual condition.

Verifying the compliance of the mamad is also a key control point. The mamad is the secure room (civil defense standard) present in most dwellings. We check that the doors and locking systems of the mamad comply with the lease description. If the contract mentions a secure room, it must meet expected security standards so as not to engage the landlord’s liability in the event of an alert.

Registration and proof of ownership at the Tabu

To guarantee the landlord’s legitimacy, obtaining a recent extract from the tabu is essential. The tabu is the official land registry in Israel. This document confirms that the person signing the contract is indeed the legal owner or holds a valid power of attorney. We compare the identity appearing on the tabu extract with that of the contact person to prevent any fraudulent rental attempts.

Reviewing the title of ownership allows us to verify the absence of liens or seizures. An apartment subject to seizure proceedings or complex mortgages can pose legal problems during lease signing. We verify that the property is free of any major legal encumbrances that could compromise the validity of the rental contract.

Finally, we compare the lease agreement with the land registry data. This includes verifying the apartment description (surface area, number of rooms, outbuildings) to ensure there is no discrepancy between what is being rented and what is officially registered. This rigor is the only effective protection against later disputes, particularly during a lease termination in Israel: rules and advice for exiting a contract or during a lease end in Israel: renewal or changing tenants.

Before any signature, always request a tabu extract dated less than three months ago. This is the only document that proves ownership and protects your right to rent the property legally.
