Renting an Apartment from an Estate in Israel: The Steps

To rent an apartment inherited in Israel, you must first obtain the tsav yerusha issued by the family court to prove your legal capacity to act. Drafting the lease requires the agreement of all heirs or the designation of a single representative to sign the contract. Once the property is registered at the tabou, you must secure payment via a shtar ’hov and transfer the arnona and vaad bayit accounts to avoid accumulating debt.

Obtaining the tsav yerusha to confirm ownership

The transfer of real estate after a death is not as simple as reading a tzava’a. If the deceased left a will, it must be validated by the court to become enforceable. Without this validation, heirs have no legal title to conclude a rental contract or sign administrative documents. The family court issues the tsav yerusha, which is the essential succession order to prove who holds the rights to the property.

Once the order is obtained, you must verify that the property is correctly registered at the tabou. The land registry is the only irrefutable proof of ownership in Israel. If only the deceased’s name appears on the registry extract, the tenant or their financial institution could contest the validity of the rental. We advise having the registration status verified by a lawyer or legal professional to ensure that the yerusha has been properly transferred to the heirs before any rental procedures begin.

This step is distinct from simply possessing the keys. In Israel, management capacity is strictly linked to registration or a judicial order. For those wishing to invest in Israel via an inheritance, this phase constitutes the legal foundation of the operation. Without the official court document, no lease can be enforceable against third parties.

Managing multiple heirs in lease drafting

The succession of an apartment often creates a situation of co-ownership. Multiple heirs hold shares in the same property, which complicates the signing of the rental contract. A lease signed by a single heir without the consent of the others may be declared void. To avoid this deadlock, heirs must designate a single representative through a written act. This representative will act on behalf of the group to sign the lease, collect rent, and authorize repairs.

The distribution of rental income must strictly respect the yerusha shares. If the property is shared among three heirs with different quotas, the rent collected must be redistributed according to those same proportions. For more details on sharing mechanisms, consult our article on Succession of an apartment in Israel with multiple heirs.

Managing emergencies is a frequent point of friction. When a water leak occurs or equipment breaks down, the decision to use succession funds must be made quickly. If only one heir resides in Israel, it may be useful to delegate the power to manage immediate interventions to them via power of attorney. This avoids waiting for a response by email or phone from abroad for repairs that cannot be delayed.

Preparing the property before the tenant moves in

Before handing over the keys, you must identify the actual condition of the unit to prevent the tenant from blaming you for pre-existing damage. We recommend hiring a professional to perform a building inspection (bedek bayit). This inspection allows for a list of visible defects and documents the condition of the apartment. This document will serve as a basis during the move-out inspection.

Certain equipment specific to Israeli housing requires particular attention:

  • The doud shemesh: verify that the solar water heater is working and that water pressure is constant.
  • The mazgan: test each air conditioning unit to ensure they do not leak and cool properly.
  • The mamad: check the seal of the door and windows of the secure room, a mandatory security feature.

A failure of the doud shemesh in the middle of winter or a defective mazgan in summer generates immediate repair requests. By having a professional confirm the proper functioning of these elements before the tenant moves in, you limit disputes regarding responsibility for routine maintenance failures.

Securing payment and financial guarantees

In Israel, the most common guarantee for a residential lease is the shtar ’hov. This is a promissory note signed by the tenant and, often, by their arev (the guarantor). This document is an acknowledgment of debt that allows for rapid execution proceedings in case of non-payment. Note: the shtar ’hov is not insurance. It does not guarantee payment; it constitutes a debt instrument that allows for the seizure of the debtor’s accounts or assets.

Do not confuse the shtar ’hov with a security deposit. The deposit is a sum paid to the landlord, while the promissory note is a legal commitment. To secure the execution of this instrument, we verify the validity of the guarantor’s teoudat zeout. A valid and current ID is indispensable to formally identify the arev in case of legal recourse.

Type of guarantee Legal nature Primary use
shtar ’hov Acknowledgment of debt Collection of unpaid rent
Security deposit Cash sum Coverage of physical damage
arev Natural person Guarantee of tenant solvency

Transferring utilities and municipal taxes

As soon as the tenant moves in, responsibility for charges must be transferred. The first point concerns the arnona. Municipal tax is normally established in the name of the owner or the occupant. You must proceed with switching the subscription from the deceased’s name to that of the heirs, or directly to the designated manager, to prevent bills from accumulating on the succession account. If you are a non-resident owner, consult the rules for renting an apartment in Tel Aviv as a non-resident.

At the same time, managing the vaad bayit is crucial. Condominium fees must be paid regularly to prevent the building management from blocking access to certain services or initiating proceedings against the apartment. A vaad bayit debt can burden the property value and complicate any future transaction. We systematically verify the absence of debt with the building management before signing a new lease.

Finally, do not forget the transfer of water and electricity meters. In Israel, these services are tied to the occupation of the dwelling. A change in occupant without updating the contracts can lead to disputes regarding the consumption by the previous tenant.

Reporting income to the reshut ha-misim

Collecting rent generates a tax obligation. Rental income is subject to mas hachnasa (income tax). For owners residing outside of Israel, the methods for declaration and withholding at the source may vary. You must declare this income to the reshut ha-misim. To minimize the tax impact, keep all supporting documents regarding deductible expenses, such as vaad bayit fees or major repairs.

One point of vigilance concerns the mas shevach. This real estate capital gains tax is due upon the resale of the property. The cost basis of the property, used to calculate the gain, can be impacted by how the succession was handled and by the expenses incurred for putting the property up for rent. Poor management of documentation during the succession phase can lead to incorrect taxation during the sale.

It is advisable to maintain an accurate record of every transaction:

  1. Gross amount of rent collected.
  2. Management and maintenance fees paid.
  3. Amount of municipal taxes and condominium fees.
  4. All invoices for professional service interventions.

Once the succession deed is signed and the lease is concluded, daily management becomes an operational burden. Who receives the keys? Who manages a tenant’s call on a Friday night regarding a water leak? Who follows up on arnona payments? To delegate these tasks and avoid managing emergencies from a distance, we offer our property management services.
