Security Deposit Refund in Israel: Shtar ’Hov and Procedures

The distinction between the security deposit and the shtar ’hov

The return of a security deposit in Israel depends on the type of guarantee signed during the lease. If you received a cash deposit, you must return it after deducting any outstanding utility bills or justified repair costs. If the guarantee is based on a shtar ’hov, you do not return cash, but you must return the original promissory note to the tenant once the contract is closed. Verifying arnona and vaad bayit invoices systematically precedes any reimbursement.

In Israel, common practice differs from typical rental management in the US or UK. A tenant does not always provide a cash sum into an escrow account. They often sign a shtar ’hov, a promissory note that binds the tenant and sometimes an arev (guarantor). This document is a claim instrument: it allows the owner to claim a sum in case of default, but it does not constitute a reserve of immediately available liquid funds. If the tenant fails to pay, the owner must initiate legal proceedings to execute this instrument; they cannot simply « withdraw » from the shtar ’hov to pay a contractor.

A cash security deposit, if paid, must be managed rigorously. Contrary to common belief, a shtar ’hov is not insurance. It does not cover risks automatically. At the time of signing, we verify the validity of the shtar ’hov and the identity of the arev. At the end of the lease, returning the shtar ’hov is the act that releases the tenant from their obligation. If you have opted for remote management, handling these physical documents is a major point of vigilance.

Type of guarantee Legal nature Action at end of lease
Cash deposit Sum paid into an account Refund of funds after deductions
shtar ’hov Promissory note Return of the original to the tenant
Security check Uncashed check Return of the physical check

The inspection and the practice of bedek bayit

To avoid disputes during the return of the deposit, the move-in/move-out inspection must rely on material facts observed by professionals. We recommend organizing a building inspection, called bedek bayit, performed by a specialist before the tenant moves in. This step is not a legal requirement, but it constitutes the only technical evidence applicable in case of a dispute regarding the condition of the apartment.

The inspection must focus on technical elements that, in Israel, face specific stresses. We systematically verify the operation of the doud shemesh (solar water heater) and the condition of the mazgan (air conditioner) compressors. A poorly maintained mazgan can lead to significant repair costs that a tenant may attempt to pass off as normal wear and tear. Similarly, the sealing of the joints around the doud shemesh must be documented.

The inspection report must be exhaustive. We systematically attach dated photographic documentation to the lease agreement. This file must include:

  • The condition of the paint and floors.
  • The operation of electrical outlets and lighting.
  • The condition of woodwork and locks.
  • The presence and condition of the mamad (secure room), specifically the seals of the reinforced door.
  • The operation of faucets and the absence of visible leaks.

Without this support, the owner finds it impossible to prove that a degradation was not present at the time of move-in.

Management of HOA fees and arnona

The return of the deposit cannot occur without a complete audit of the apartment’s accounts. The tenant is responsible for charges related to their occupancy. We proceed with the verification of vaad bayit invoices to ensure no HOA arrears have been left by the tenant. Building fees must be up to date so that the owner is not contacted by the building management for debts incurred by a third party.

Controlling the arnona is equally crucial. Municipal tax is linked to the occupancy of the home. We ask the tenant to provide a clearance certificate from the municipality, or we verify the apartment account directly on the municipal portal. If the tenant leaves with an arnona debt, the owner may be forced to settle it to avoid penalties, and can then deduct this amount from the security deposit.

The distribution of utilities follows a similar logic. The tenant’s departure must trigger a verification of consumption:

  1. Reading water meters to close the consumption period.
  2. Verifying the last payment of the electricity bill.
  3. Checking the balance of the gas bill.
  4. Validating the payment of vaad bayit charges for the pro-rata period.

Using the deposit to cover these arrears is standard practice, provided the amounts are justified by official invoices or statements.

Repairs and deductions from the guarantee

Any deduction made from the security deposit must be based on a clear distinction between routine maintenance and damage. Routine maintenance, such as cleaning or replacing small light bulbs, is the tenant’s responsibility. Damage requiring a professional, such as repairing a leak or a damaged wall, allows for a deduction from the deposit. We calculate the amounts to be deducted based on quotes from local contractors, rather than flat-rate estimates which are often contested.

Certain elements of an Israeli apartment require special attention. The mamad, for example, has technical components (reinforced doors, locking mechanisms, specific sealing) that must not be handled without expertise. If a mamad door is damaged, the repair must be done by a qualified professional to maintain security standards. We require the invoice from this professional to justify the deduction to the tenant.

The notification procedure is an essential step to protect the owner. Before proceeding with any deduction, we inform the tenant in writing of the nature of the observed damage and the estimated repair costs. This transparency limits the risk of legal disputes. If the owner is a non-resident, this communication must be managed with legal precision to prevent the tenant from claiming they were deprived of their right to defense.

The fund return process and contract closure

Once deductions are validated, the transfer of funds must be performed in a traceable manner. We prefer bank transfers for cash deposits, as they leave an indelible record of the transaction. A cashier’s check is an alternative, but a transfer is faster for owners living abroad. The return must occur simultaneously with the return of the keys. The return of the keys marks the end of the tenant’s legal custody of the apartment.

For owners managing their property remotely, closing the lease requires increased administrative rigor. We verify the validity of the tenant’s teoudat zeout to ensure the transfer of funds is made to the correct person and to prevent fraud. If the tenant is a foreigner without a teoudat zeout, transfer methods may be more complex and require additional identity verification.

The release of guarantees is the final step. If the contract provided for a shtar ’hov, we return the original to the tenant at the same time the contract is closed. If you need to delegate these complex administrative tasks, our property management handles this entire process, from the initial inspection to the final return. For owners considering selling their property after a rental, maintaining these records is an asset during the transaction, in accordance with the rules regarding Power of Attorney for the sale of real estate in Israel.

Disputes and recourse with Israeli authorities

In the event of a major disagreement regarding the amount of deductions, the dispute may extend to tax authorities. The reshut ha-misim (the Israeli Tax Authority) monitors the consistency between declared rental income and financial flows. A deduction from a security deposit must be correctly documented so it is not reclassified or to justify the adjustment of taxable income. The owner must keep all expense receipts to prove that the deduction is not additional income but compensation for costs.

For disputes involving moderate amounts, small claims courts are the competent instances. The procedure is generally faster than in traditional civil courts. However, a prolonged dispute can impact the tenant’s reputation in the Israeli credit system, though this is not a legal lever for the owner. Resolution must remain strictly based on material evidence and the clauses of the lease agreement.

A special case arises if the owner passes away during a lease. The management of the security deposit then falls under the framework of yerusha (inheritance). The funds or guarantee documents become assets of the estate. Heirs must then obtain a tsav yerusha (probate order) issued by the family court to legally manage ongoing contracts and proceed with returns. Understanding Real Estate Succession Documents in Israel: The Essentials is then paramount for beneficiaries to avoid blocking property management.

Before returning any security deposit, always demand a clearance certificate for arnona and vaad bayit. A calculation error on these charges is the primary cause of disputes between owners and tenants in Israel.
