Signing a Lease for an Inherited Apartment in Israel from France

To sign a lease for an inherited apartment in Israel from the United States, you must first obtain the inheritance order (tsav yerusha) from the family court, which grants you the authority to act. Next, you draft a special power of attorney specifying the lease signature and key handover, which you entrust to a local attorney admitted to the bar. This agent acts on your behalf to finalize the contract, secure payments via a shtar hov, and manage fees, without requiring you to travel.

Obtaining the authority to sign: the role of the tsav yerusha and the family court

In Israel, the legal capacity to dispose of inherited real estate does not arise from the death, but from the intervention of the family court. The distinction is fundamental: opening the estate confirms the death and identifies the heirs, but it does not grant the power to sign a lease or sell. It is the inheritance order, or tsav yerusha, that transfers the rights of management and disposition. Without this document, any signature is null and void in the eyes of civil courts.

The process begins with filing a petition at the court competent for the deceased’s last residence. Once the petition is filed, a legal period elapses before the court can issue the order. This period allows potential heirs to object to the succession if they wish. Therefore, you cannot sign the lease immediately after the death. You must wait for the publication of the order in the official registry.

This mechanism differs radically from the United States, where a certified copy of the will or probate documents often suffices to manage the property. In Israel, the family court is the sole body authorized to confer this power. If you are the sole heir, the process is faster, but it remains mandatory. If you are a co-heir with others, the order must list each of you. In this case, the power of attorney you grant to your local agent must be signed by all heirs or by a representative designated by the entire group, under penalty of invalidity. Verify the exact wording of the order to determine whether it authorizes individual or collective action.

The special power of attorney: drafting a mandate that only allows the lease signature

Once the inheritance order is obtained, you must draft a special power of attorney. This document must not be a general management mandate. It must strictly limit the agent’s powers to the specific act: signing the lease for the apartment at the specified address, handing over the keys to the tenant, and collecting the initial rents. Any vague wording such as “manage the real estate” exposes the agent to actions outside your will and exposes you to future disputes.

The power of attorney must attach a certified copy of the inheritance order. The tenant and the Israeli court will require this proof to verify that the agent is acting as a legitimate heir. Without this document, the lease may be contested. The drafting of the power of attorney can be done in the United States. It is not necessary to have it legalized by an Israeli consulate for it to be valid in Israel, provided that the signature is authenticated by a notary public or a commission rogatoire. The local agent will present this document to the court or the tenant to prove their authorization.

Specify the validity period in the power of attorney. An indefinite mandate is risky. Set an expiration date, for example, six months after the lease signature. Also indicate whether the agent can initiate legal proceedings in case of non-payment. If the answer is yes, the power of attorney must state this explicitly. If the answer is no, the agent must consult you for any legal action. This precision avoids unexpected legal fees. Finally, keep an original copy of the signed power of attorney in your possession. The agent only needs a copy to act, but the original remains your guarantee in case of a challenge to their good faith.

Choosing the agent: local attorney or relative in Israel

The choice of agent determines the reliability of the management. The most common approach is to entrust the task to a local attorney admitted to the Israeli bar. Bar admission, verifiable via the public registry of the Ne’eman, is the sine qua non condition of legal legitimacy. An attorney can represent your interests before civil and family courts. A relative residing in Israel can also serve as an agent, but they cannot plead on your behalf if they are not an attorney. They can sign the lease and manage daily affairs, but any judicial procedure must be entrusted to a legal professional.

The main risk lies in conflicts of interest. If the agent is also an heir, their position is ambiguous. They manage the property for the benefit of all, including themselves. This situation complicates accounting and transparency. It is preferable to choose a third-party agent, with no family ties to the deceased or other heirs. Verify their references. Ask them to list the clients they currently represent. An overloaded attorney will not be able to follow the details of your lease with the required attention. Responsiveness is crucial: signing a lease, receiving fee notices, and responding to repair requests cannot wait.

The agent must be able to communicate in English or provide certified translations of all important documents. Israeli law is complex and specific. A poor translation of a termination clause can be costly. Require the agent to send you a copy of each signed document before it is handed to the tenant. This transparency allows you to verify that the negotiated terms correspond to your mandate. If the agent refuses this transparency, do not choose them. Trust is the basis of the relationship, but written proof is the basis of legal security.

Lease content and indexation to the cost-of-living index

The Israeli lease obeys strict rules regarding rent evolution. Unlike in the United States, where a revision can be fixed contractually, in Israel, rent increases must be linked to the official cost-of-living index. You cannot insert a fixed increase of one or two percent per year in the lease. The clause must state that the rent is re-evaluated according to the variation of the index published by the Central Bureau of Statistics. This indexation protects the owner against inflation, but it is also a tenant right. Any contrary clause is null.

The lease must detail maintenance responsibilities. The mazgan (air conditioner) and the doud shemesh (solar water heater) are fixed equipment. The owner is generally responsible for structural failures, while the tenant assumes routine maintenance and consumables. Specify who pays for labor in case of a doud shemesh failure. If the failure is due to a manufacturing defect or normal wear, it is the owner. If it is due to misuse, it is the tenant. This distinction avoids disputes. The lease must also mention the presence or absence of a mamad (safe room) or mamak (common protected space), as this impacts rental value and insurance.

The termination notice clause is specific to Israeli law. The lease must indicate the notice period the tenant must respect to vacate the premises, and the one you must respect to terminate the lease. These periods are negotiable, but they must be clear. The lease must also specify the conditions for key return and the condition in which the apartment must be returned. Finally, the lease must be signed in two original copies, one for you and one for the tenant. The agent keeps the owner’s original. The start date of the lease is the date of key handover, not the date of signature. This distinction is essential for calculating rents and fees.

Managing fees: arnona and vaad bayit from the United States

Fee management is one of the most complex aspects for an owner residing abroad. The arnona is the municipal housing tax. It is due by the occupant of the dwelling. The lease must state that the tenant is responsible for paying the arnona. However, the city often sends payment notices in the owner’s name, that is, you. The agent must receive these notices and forward them to the tenant, or deduct the amount from the rent if the lease allows. If the tenant does not pay, the city can issue a formal demand. The agent must follow up on these steps to avoid late penalties at your expense.

The vaad bayit are the building association fees. They cover the maintenance of common areas, building insurance, and sometimes security. Payment of vaad bayit is generally the owner’s responsibility, as they concern the structure of the property. The agent must receive the association’s fund calls and pay them from a local bank account. They must also attend general assembly meetings or be represented there. They must vote on major works and verify that decisions do not excessively burden the building budget. You must receive a report from each meeting. If the agent cannot attend, they must designate a representative authorized to vote on their behalf.

To facilitate these payments, the agent must open a local bank account. This account will be used to receive rents and pay arnona and vaad bayit invoices. You can fund this account from the United States via international wire transfer. The agent must provide you with monthly bank statements. Financial transparency is essential. If the agent uses personal funds to pay fees, they must request immediate reimbursement. Do not let debts accumulate. A dedicated account allows you to trace every dollar or shekel spent. This strict separation between your funds and the agent’s protects your assets.

Securing payment: the shtar hov and the guarantor

The security of rent payment relies on the shtar hov. This promissory note is signed by the tenant and their arev (guarantor) before key handover. The shtar hov is a debt acknowledgment. It is not insurance, but an enforceable title. If the tenant does not pay, you can execute this title directly without going through a long trial. The amount of the shtar hov must cover several months of rent. The guarantor’s signature is crucial. They personally commit to pay if the tenant defaults. The choice of guarantor must be rigorous. Verify their solvency via their teoudat zeout (ID card) and bank references.

In Israel, there is no mandatory security deposit check as in the United States. The shtar hov is the main security tool. Some owners also request a security deposit, but it is less common and less effective than the shtar hov. The shtar hov is a strong legal document. It must be drafted by an attorney or under their control. The clauses must be clear on reimbursement conditions. If the tenant vacates the premises in good condition and without arrears, the shtar hov must be returned or cancelled. The agent must keep the original shtar hov in a secure location. Its loss would make execution impossible. Make a certified copy and send it to your address in the United States.

Guarantor verification is a critical step. A guarantor without income or in debt is useless. The agent must request recent proof of income. They must also verify the absence of ongoing litigation against the guarantor. A guarantor involved in financial disputes is risky. The lease must specify that the shtar hov remains valid until key return and the end of any collection procedure. This clause protects the owner in case of a sudden tenant departure. The agent must inform the tenant of this clause at signature. Transparency on security conditions avoids future misunderstandings.

Key handover and condition report without inspection

Key handover marks the start of the lease. It must be documented by a detailed condition report. This document lists the state of each room, walls, floors, and equipment such as the mazgan and doud shemesh. It is signed by the agent and the tenant. Dated photos must accompany the report. This written proof is essential to distinguish tenant damage from normal wear. Without a precise condition report, any dispute over return will be difficult to resolve. The agent must ensure the tenant has received all keys, including those for the mamak if applicable.

In Israel, there is no mandatory “technical inspection” as in the United States. You have no legal obligation to have an expert report done before renting. However, if you wish for a formal technical state, you can have a professional inspect the building, or bedek bayit. This inspection is not an obligation, but an option. It allows you to note the structural state of the apartment and document existing defects. The cost of this inspection is borne by the owner. The report can be attached to the condition report. It strengthens the owner’s position in case of a tenant claim on a pre-existing defect. The agent can organize this inspection before key handover.

The physical key handover must be proven in writing. An email from the agent confirming the handover, or the tenant’s signature on the report, fixes the move-in date. This date determines the start of rent and fee payments. In case of a dispute over the move-in date, this proof is decisive. The agent must keep a copy of the signed report. They must also send a copy to your address in the United States. The key handover date must correspond to the lease start date. If keys are handed over before the scheduled date, rent is due from the handover. This precision avoids disputes over the first months of tenancy. The administrative rigor of this step protects the owner against subsequent tenant claims.

Rental taxation: mas hachnasa and reshut ha-misim

Rental income received in Israel is taxable. The declaration is made to the reshut ha-misim, the Israeli tax authority. The agent must handle this annual declaration. Income tax, or mas hachnasa, applies to rents received. It is distinct from capital gains tax, or mas shevach, which only concerns the sale of real estate. Rents are taxed at the progressive income tax rate. The agent must declare gross income and deduct deductible fees, such as loan interest, if applicable, or management fees.

VAT generally does not apply to residential rents. The rental of an apartment for residential use is exempt from VAT. However, if the apartment is rented to a business for commercial use, VAT may apply. The agent must verify the nature of the lease. If the tenant is a business, invoices with VAT must be issued. If the tenant is an individual, no VAT is due. This distinction is crucial for accounting. The agent must keep a register of income and expenses. This register is the basis of the tax declaration. Any error in this register can lead to penalties from the reshut ha-misim.

Tax management is complex for a foreign resident. The United States and Israel have a tax treaty to avoid double taxation. Real estate income is generally taxed in the country where the property is located, that is, Israel. You must therefore pay tax in Israel. You can then request a tax credit in the United States for taxes paid in Israel. The agent must provide you with proof of Israeli tax payment. These documents are necessary for your US declaration. Do not neglect this step. Double taxation is a real risk if the procedure is not followed. The agent must collaborate with your accountant in the United States to ensure compliance of both declarations. Coordination between the two authorities is your responsibility, facilitated by the documents provided by the agent.

Never sign a general power of attorney. Limit the agent’s powers to the lease signature and routine management. Require the certified copy of the tsav yerusha before any action. Verify the agent’s admission to the Israeli bar. Have the shtar hov drafted by an attorney. Keep all original copies in the United States.
