Tenant wants to leave the Netivot apartment without notice: your rights

When an elderly tenant decides to leave their housing in Netivot without respecting the contractual notice period, the owner must rely on the termination clauses written in the lease to claim the rent due until the scheduled term. If the tenant is no longer able to manage their own affairs, the intervention of the arev is necessary to validate the departure and engage their financial responsibility. In the event of death, the management of the departure shifts to the framework of yerusha, requiring the presentation of a tsav yerusha to identify the legal interlocutors.

The contractual framework regarding the unexpected departure of an elderly tenant

The lease agreement signed in Israel strictly defines the conditions for termination. Unlike practices in other countries, Israeli law grants almost absolute primacy to the will of the parties as written in the signed document. If the contract provides for a fixed term without an early exit clause, the tenant remains liable for the full amount of rent until the end of the agreed period, even if they move into a care facility (Beit Avot).

We verify the presence of an early termination clause that would allow the tenant to leave by providing specific notice. If this clause is absent, leaving without notice constitutes a breach of contract. In this context, the arev plays a decisive role. If the tenant is physically unable to sign a termination document or vacate the premises, we contact the arev to obtain their signature on the move-out inspection and on the commitment to pay the remaining amounts due. The arev is the financial guarantor responsible for the execution of the primary tenant’s obligations.

Leaving for health reasons does not, in itself, constitute a legal ground for automatic lease termination. The owner is not required to accept an immediate departure without compensation, unless the contract explicitly provides for a force majeure or health clause. For those who wish to rent from abroad, this distinction is fundamental: the absence of notice is not an option; it is a contractual debt.

Managing the lack of notice: using the shtar ’hov

When a tenant leaves the apartment without respecting the notice period, the owner suffers an immediate loss of income. To compensate for this situation, we use the shtar ’hov. This document, signed upon moving in, is a promissory note that allows for the claim of due sums without going through a complex procedure to prove the existence of the debt itself. It is not insurance, but a debt instrument.

The calculation of the claim is based on the difference between the effective departure date and the lease end date specified in the contract. We proceed with the calculation of the remaining rent, including cost-of-living indexation if the contract provides for it. The shtar ’hov allows for rapid collection proceedings against the arev if the tenant can no longer pay.

Type of guarantee How it works in Israel Use during departure without notice
Shtar ’hov Signed promissory note Allows for claiming remaining rent until the end of the lease.
Bank guarantee Funds blocked in an account Covers physical damage or unpaid utility charges.

A sudden departure can also lead to a depreciation of the asset if the apartment remains empty and unmaintained. An unplanned vacancy period impacts the owner’s cash flow management. If the tenant leaves without allowing time to re-rent, the shtar ’hov serves as the basis for claiming the contractual vacancy months.

Transferring the housing in the event of a tenant’s death

The death of a tenant transforms the rental relationship into a yerusha situation. Heirs may sometimes attempt to occupy the premises without having a title of ownership or an explicit lease right. In Israel, managing these situations requires caution to avoid leaving occupants without legal status in the apartment.

To clarify who is authorized to sign a lease termination or to collect the keys, we request the presentation of the tsav yerusha. This succession order, issued by the family court, is the only document allowing for the confirmation of the heirs’ identities and their respective rights to the deceased’s assets. Without this document, the owner cannot legally conclude a transaction with the relatives.

During the transition period between the death and the designation of the heirs, the owner must maintain the monitoring of charges. We verify that the arnona and vaad bayit fees are properly covered. If the tenant’s bank account is frozen following the death, the owner must ensure that the arev takes over the payment of current charges to avoid an accumulation of debt on the building. This period is delicate and may require vacating an apartment occupied by a tenant in Israel if the heirs do not regularize their situation.

The move-out inspection: technical inspection and security

The departure of an elderly person can hide damage invisible to the naked eye. We recommend bringing in a professional to perform a bedek bayit. This building inspection allows us to verify if prolonged use or a lack of specific maintenance related to age has impacted the technical installations.

The inspection must focus on specific points:

  • The operation of the doud shemesh: checking for leaks on the roof and the condition of the solar tanks.
  • Plumbing: checking for leaks under sinks and water pressure, often affected by added comfort installations.
  • The mazgan: verifying the condition of the indoor and outdoor units.
  • The mamad: checking the sealing of the armored doors and the condition of the walls to guarantee the compliance of the secure room.

If damage is found, we establish a list of necessary repairs. The restoration costs are then charged either to the security deposit or directly to the arev via the shtar ’hov if funds are insufficient. This step is crucial to prevent the owner from bearing the sole cost of restoration following a long-term occupancy.

Closing accounts and transferring municipal charges

The end of the lease requires a rigorous closing of accounts to prevent the owner from inheriting the former occupant’s debts. We proceed with the verification of payments for each expense item. The pro-rata calculation of the arnona is performed up to the day the keys are effectively handed over, not the date the termination is signed.

We systematically verify the settlement of vaad bayit accounts. A common area debt can lead to complications with the building management and impact the overall management of the building. Simultaneously, we supervise the transfer of water and electricity meters. It is necessary to ensure that readings are taken in the presence of a representative or via a dated photo to avoid any subsequent dispute regarding consumption.

In the event of a debit balance on charges, we use the available guarantee funds. If an overpayment is noted (for example, rent paid in advance covering a period after departure), we proceed with the refund after deducting any repairs validated during the bedek bayit. This accounting rigor is indispensable for healthy management, especially if the property was acquired during a new apartment handover in Netivot.

Re-renting the apartment after a health-related departure

After the departure of a senior tenant, the apartment configuration may require adjustments. We evaluate whether equipment installed to facilitate the daily life of the elderly tenant (grab bars, height modifications) is compatible with a new tenant profile. The goal is not to limit the rental target without technical necessity.

Before any new rental, we verify the compliance of the mazgan and other appliances. An apartment that has been occupied by a person with reduced mobility may show different wear on common areas and comfort equipment. We evaluate the need for refreshing work, such as new paint or the replacement of certain plumbing elements, to maintain the rental value of the property.

Searching for new tenants in Israel follows different codes than those practiced in Europe. The speed of the transaction and the importance of verifying the teoudat zeout and the solvency of the arev are critical steps. We adapt advertisements to target profiles that match the current characteristics of the housing, highlighting strengths such as the presence of a mamad or the quality of the doud shemesh.

When managing an unexpected departure, do not sign any liability release document without having obtained the tsav yerusha in the event of death, and ensure that the arev has validated the move-out inspection to guarantee the recovery of due sums via the shtar ’hov.
