Homeowner’s Insurance During the Construction of a Mamat in Israel

Standard home insurance does not cover damage caused by construction work on a mamad. Liability falls to the contractor’s or developer’s insurer, not your personal policy. If an incident occurs during construction, your tenant insurance may refuse to cover building damage. You must require written proof of « construction » coverage before work begins. In Israel, the distinction between property insurance and construction site insurance is strict and unambiguous.

The gap in standard insurance coverage

Many owners assume that their home insurance covers everything that happens inside the apartment. This is false once structural work begins. Standard insurance covers personal property and the tenant’s civil liability. It does not cover the reconstruction of the building if it is in the phase of finishing or major modification.

When you have a mamad built, you alter the integrity of the structure. If a fire breaks out due to an electrical installation error during the work, the insurer will examine the condition of the property. They will check if the apartment is declared « habitable » or if it is an active construction site. In the case of an active site, the standard policy is suspended for damage to the building structure. The insurer will consider that the risk is managed by the developer’s or construction company’s insurance.

This logic differs significantly from the US or UK. In those markets, standard policies often provide continuous and integrated coverage. In Israel, there is no automatic handover. If you have not taken out specific insurance for the construction period, you are exposed. The insurer may refuse indemnification by citing the exclusion of « ongoing works. »

The tabou (land registry) plays a documentary role here. The insurer may consult the property status to verify if work permits have been filed. If the work is illegal or undeclared, coverage is automatically void. You must ensure that all permits are in order.

To avoid this risk, you must request a certificate from the site insurer specifying that it covers « third-party damage » and « damage to the main property » for the entire duration of the work. Without this written document, you have no protection. The mere existence of insurance with the developer is not enough; you must verify the exclusions.

The shtar ‘hov and financial security

The shtar ‘hov is a financial instrument, not insurance. It is a promissory note signed by the tenant and their arev (guarantor). It guarantees the payment of rent. It does not cover any physical damage. If the apartment is damaged by water from the doud shemesh (solar water heater) pipe during the construction of the mamad, the shtar ‘hov will not pay for the flooring or walls.

Consider a concrete case. The tenant has signed a shtar ‘hov for three years. The mamad work causes a plumbing leak. Water floods the floor. The tenant continues to pay rent via the shtar ‘hov, but the property is uninhabitable. The arev guarantees the debt, not the damage. They will not pay for repairs.

You must check the termination clause in the lease. In Israel, the lease may stipulate that if the property is unavailable for a certain period due to an unrepaired incident, the tenant can terminate without penalty. But if the lease is silent, the tenant remains obligated to pay rent even if the apartment is unusable. This is a crucial point of negotiation before signing.

Never confuse financial guarantees with physical risk coverage. The shtar ‘hov protects your cash flow against non-payment. It does not protect your real estate capital against an incident. For that, you need specific « construction » insurance.

If the tenant converts the mamad into a main bedroom without authorization, this can void insurance coverage. Consult our article on occupying and living in the mamad to understand the legal limits.

Who pays for construction insurance?

Responsibility for construction insurance depends on the nature of the project. If you buy a new property, the developer must take out « all-risk construction » insurance. This policy covers third-party damage, delivery delays, and damage to the main property during construction. You must require a copy of this certificate before moving in. If the developer cannot provide it, it is a major red flag.

If you renovate an existing property to add a mamad, the responsibility falls on you. You must take out specific « construction » insurance. This policy covers damage caused by workers, site fires, and damage to existing installations. The vaad bayit (co-ownership association) only covers the common structure of the building. It does not pay for interior work in your apartment.

To verify the policy, ask the insurer to confirm in writing that « damage to tenant’s property » is covered. Many standard policies exclude tenant property during construction. You must insist on this clause. If the insurer refuses, change your provider or developer.

The cost of this insurance is often overlooked. It must be budgeted separately. Do not count on the vaad bayit insurance to cover your work. This is a frequent source of conflict between owners and management.

If you plan to sell the property after renovation, the presence of complete construction insurance is a selling point. It reassures the buyer about the quality of the work. For more information on the impact of property condition on value, consult our guide to buying or selling in Israel.

Inspection by bedek bayit

Hiring a professional to document the initial state is essential. A building inspection (bedek bayit) before work begins serves as evidence in case of dispute. The report must detail the condition of the walls, plumbing, and electricity. If damage occurs during the work, this report helps prove that the damage did not exist beforehand.

Document the work. Take dated photos of each phase. Note the installation of the lock, wall reinforcement, and ventilation setup. These elements are crucial for verifying that safety standards are met. A poorly insulated mamad can become a fire hazard.

The final inspection is equally important. Verify that the work has not damaged the structure or electrical installations. The final report must confirm that the mamad complies with safety standards. This document is essential for claiming indemnification if an incident occurs shortly after acceptance.

In Israel, there is no mandatory « technical inspection » like in some other countries. But expert proof is crucial. The insurer only indemnifies if there is proof of a causal link between the work and the incident. Without an expert report, the insurer may deny this link.

If infiltration occurs in the new mamad, the claim procedure is different. Consult our article on repairing infiltration in a new mamad to understand the builder’s responsibilities.

The impact of arnona and taxes

The arnona (municipal residence tax) continues to accrue even if the apartment is partially unavailable due to work. You must pay the tax to the city. There is no automatic exemption for renovation work.

However, some insurance policies include « loss of income » coverage if the property becomes uninhabitable. Check if the clause covers the construction period. The distinction between « uninhabitable » and « inconvenient » is important. The insurer only covers lost rent if the apartment is totally inaccessible or dangerous. If only the mamad room is being installed, the apartment remains habitable. Lost rent is therefore not covered.

Advise the owner to check with their broker if the premium changes based on the property’s condition. A property under renovation may have a different premium than a completed one. Do not assume the premium remains identical.

The tax impact must also be considered. Renovation work can affect the deductibility of certain expenses. Consult an accountant to verify the impact on mas hachnasa (income tax). Do not count on an automatic deduction.

If the property is rented, the construction period may lead to a rent reduction. Negotiate this reduction with the tenant. The shtar ‘hov does not allow unilateral modification of the rent amount. Any modification must be consensual.

The case of the common mamak

If the apartment does not have an individual mamad and a mamak (common protected space on the floor) is arranged, the situation is more complex. The mamak is a common area. Its modification requires the approval of the vaad bayit.

The vaad bayit insurance covers the structure of the mamak. But it does not cover tenant property inside. If a fire breaks out in the mamak due to poorly executed work, the co-ownership insurance will pay for structural damage. Damage to tenant property will be covered by their individual insurance.

Verify that work on the mamak is covered by the co-ownership insurance. Request written proof. If the vaad bayit refuses to cover the work, you must take out additional insurance.

The mamak is often neglected in insurance policies. It is a high-risk zone because it is shared. An insulation defect can affect the entire floor. Liability is collective, but repair is individual.

If the tenant uses the mamak as a main living space, this can void coverage. Habitation standards are strict. Do not allow the tenant to modify the use of the space without authorization.

Property management and follow-up after the deed

Once the deed is signed and the work is finished, daily management becomes your responsibility. Who receives the keys? Who finds the tenant? Who answers when a pipe bursts on a Friday night?

In Israel, the owner is often absent. You need a local point of contact. We manage the entire process. We find the tenant, verify their teoudat zeout (ID card) and solvency. We sign the lease and the shtar ‘hov.

If a pipe bursts, we intervene. We bring in a licensed plumber. We verify that the work is compliant. We manage communication with the tenant. You do not have to call a plumber in Netanya from abroad.

We regularly check the condition of the mamad. We ensure the lock works and the insulation is intact. If an incident occurs, we manage the claim with the insurer. We provide inspection reports and photos.

Our service includes rent management, collection of vaad bayit fees, and payment of arnona. We send you a detailed monthly report. You know exactly what is happening with your property.

For complete and stress-free management, discover our property management. We transform your investment into a professionally managed asset, without you having to intervene in technical or legal details.
