How to Recover a Tenant’s Security Deposit in Israel

To recover a tenant’s security deposit in Israel, you must reconcile the apartment’s condition with payment documents for municipal rates and utility providers. Unlike the systems used in the US or UK, security is often based on a shtar ’hov, a promissory note that allows you to claim a sum without having funds held in a third-party escrow account. The procedure requires collecting clearance certificates for the arnona and the latest consumption statements before releasing any guarantee.

The shtar ’hov and security deposit management in Israel

In Israel, the practice of providing a security deposit in cash or via a blocked bank transfer is rare. Most lease agreements use a shtar ’hov (promissory note). This is a document in which the tenant acknowledges a debt to the landlord. This document is not insurance, but a debt instrument. If damages are noted upon move-out, we present this shtar ’hov to demand payment for repairs. The tenant signs this document at the start of the lease, but no money changes hands at that time.

The use of a shtar ’hov has legal limitations. If the tenant refuses to pay after the promissory note is presented, you will need to initiate collection proceedings. While the promissory note facilitates legal action, it does not guarantee the tenant’s solvency. To mitigate this risk, we systematically verify the identity of the guarantor who also signs the document. Tenant selection in Israel: documents to verify helps ensure the signatory has the financial capacity to cover a potential default.

The difference from Western systems is significant: you do not have an escrow account managed by a third party. Instead, you hold a debt instrument. In the event of a dispute, proof of debt is simplified by this document, but enforcement depends on the tenant’s ability to honor their commitment. We advise always requesting a shtar ’hov that covers not only physical damage but also potential unpaid utility bills.

Collecting energy and water bills before key handover

A tenant’s departure must be coordinated with utility consumption readings. In Israel, electricity consumption is often linked to the intensive use of the mazgan (air conditioner). We perform readings of electricity and water meters on the day the keys are returned. It is necessary to obtain the latest consumption statement to calculate the amount due between the last bill and the move-out date. If the tenant uses a doud shemesh (solar water heater), we check the system’s operation to prevent repairs related to misuse from being charged to the landlord after departure.

For water providers, we ask the tenant to present proof of account closure or a balance statement. This step prevents residual consumption bills from being sent directly to the landlord after the lease ends. The method involves calculating the estimated final consumption amount and deducting it from the sum covered by the shtar ’hov or the security deposit, if such a payment method was agreed upon.

Managing energy bills requires rigor. A tenant who leaves without settling their electricity balance can leave a debt attached to the apartment address. We verify with the distribution authority that the account is up to date. If a discrepancy is found, we use consumption bills as justification to make a deduction from the available guarantees.

Arnona and building fees: the final settlement

The arnona is the municipal property tax. It is due from the occupant of the dwelling. Upon the tenant’s departure, we request an arnona payment certificate issued by the municipality. Without this document, the landlord risks the municipality claiming tax arrears from the owner, as the former occupant is often difficult to pursue once they have left. Clearing this tax is a mandatory step before validating the end of the lease.

In parallel, building management fees, known as vaad bayit, must be settled. The vaad bayit covers common area maintenance, stair lighting, and sometimes elevator maintenance. We request a statement from the building manager or the homeowners’ association representative indicating that the tenant is up to date with their contributions. An unpaid vaad bayit can lead to complications in building management, particularly regarding routine maintenance work.

Expense Item Required Proof Document Action if Unpaid
Municipal Tax arnona payment certificate Deduction from deposit or shtar ’hov
Building Fees vaad bayit statement Deduction from deposit
Energy and Water Latest provider statement Deduction from deposit
Tenant Damages bedek bayit report Use of shtar ’hov

Building inspection (bedek bayit) to justify deductions

To justify any deduction from the security deposit, a visual observation is not always sufficient in case of a dispute. We organize a bedek bayit, a building inspection performed by a professional. This inspection allows for a precise list of damages that exceed normal wear and tear. For example, a crack in a wall or a sealing issue on a balcony requires an expert opinion. If you invest in Israel, you know that balcony maintenance is crucial to prevent leaks into lower floors.

The bedek bayit serves as a factual basis. We compare the initial condition, documented at move-in, with the move-out condition noted by the professional. Reports from specialists (plumber, electrician, or contractor) are essential to validate deducted amounts. If the tenant contests a deduction, the inspection report serves as the authority. This transforms a subjective discussion into a procedure based on technical facts.

During this inspection, we pay particular attention to the following:

  • The condition of paint and flooring.
  • The operation of electrical and plumbing installations.
  • The integrity of woodwork and windows.
  • The absence of moisture traces or unreported leaks.

Early departure and lease termination

An early departure changes the move-out management. If the tenant breaks the contract before the scheduled term, the notice period clauses defined in the lease apply. Under Israeli law, the contract is the law of the parties. We verify whether the tenant has respected the contractual notice period. If this period is not respected, the tenant may be liable for compensation corresponding to the missing rent months until the end of the notice period or until the property is re-let.

Managing restoration costs must be immediate in this context. To allow for rapid re-letting, we sometimes need to undertake urgent repairs even before the dispute regarding the shtar ’hov is resolved. We calculate restoration costs based on actual quotes obtained from local contractors. This reactivity is necessary to minimize vacancy periods, which is the primary factor in loss of yield for a landlord.

We distinguish two situations: normal lease end and early termination. In the latter case, negotiation with the departing tenant is often more complex. We use termination clauses to justify maintaining guarantees until new tenants are settled or until termination indemnities are paid.

Securing keys and access to the mamad upon departure

The mamad is the secure room of the apartment, designed for civil protection. Upon departure, we verify the integrity of the equipment in this room. The reinforced doors and specific shutters for the mamad must be perfectly functional. Damage to these elements is more costly than a standard door and requires the intervention of a specialized professional to guarantee the compliance of the secure room.

The key handover protocol includes the return of all access: physical keys, building badges, garage remotes, or digital access codes. We test each key to ensure no copies remain in circulation. The handover of keys does not constitute acceptance of the property’s condition; it simply marks the end of physical occupation. The assessment of the condition of the woodwork and the protections of the secure room must be performed simultaneously.

We also verify:

  1. The condition of locks and cylinders to prevent any risk of key duplication.
  2. The operation of the mamad window locking systems.
  3. The presence of all access badges for common areas and elevators.
  4. The absence of damage to reinforced door frames.

Before signing the move-out inspection, systematically demand proof of payment for the arnona and the vaad bayit. Never release the tenant from liability without having confirmed the absence of debt with energy and water providers. Using a shtar ’hov is your primary protection tool, but its validity depends on the precision of your technical findings.
