Lease Agreements and Signing in Israel: The Complete Guide

To sign a lease in Israel, the manager requires the tenant’s teoudat zeout or passport, proof of local income, and the identification of an arev. The file must include a signed shtar ’hov to guarantee payments and a bedek bayit report for the move-in inspection. Verifying the tabou extract ensures the landlord’s legitimacy to the tenant.

Tenant identification and verification of validity in Israel

The first step in building the file is establishing the tenant’s legal identity. We systematically request a copy of the teoudat zeout for any Israeli resident. This document is the only proof of identity recognized by the administration for civil acts. If the tenant is a foreigner, we require a copy of a valid passport as well as, if necessary, a residence visa or work permit. This distinction is crucial because it determines the duration of the tenant’s legal presence in the country and, therefore, the consistency of the lease.

We verify residency status with the competent authorities to avoid disputes related to residency rights. A tenant with precarious status can weaken the long-term management of your property. We also distinguish between the primary tenant and additional occupants. The lease agreement must explicitly mention all persons who will reside in the apartment. In Israel, unlike some practices in other countries, failing to mention an occupant in the contract can cause problems during eviction proceedings in the event of a dispute, as the law protects de facto occupants.

  • Double-sided copy of the teoudat zeout for Israelis.
  • Copy of passport and proof of residency for non-residents.
  • Nominal list of all occupants specified in the contract.

Building the solvency file and finding an arev

Solvency is not based solely on the tenant’s salary, but on the strength of the entire file. We request pay stubs from the last three months or a recent employment certificate issued by the employer. For self-employed individuals, we require activity reports or certificates from an accountant. If the tenant is a non-resident, we examine bank statements to confirm payment capacity without relying on a local salary. This allows us to measure the tenant’s financial autonomy before they move in.

The role of the arev is central to the Israeli real estate market. The arev is the guarantor who commits to paying if the tenant defaults. We ask the tenant to provide the identity of their guarantor and we proceed to verify the guarantor’s own solvency. We examine the arev‘s income and debt capacity. A file without a solid arev presents a risk that we refuse to take in your interest. This process is a fundamental step to invest in Israel with minimal security.

Profile Type Required Income Documents Additional Guarantee
Local employee Last 3 pay stubs arev with teoudat zeout
Self-employed Accountant certificate arev with proof of income
Non-resident Bank statements (6 months) Advance payment or reinforced security deposit

Implementing financial guarantees: the shtar ’hov and other securities

The guarantee system in Israel differs radically from models used in Europe or North America. We do not use rent default insurance, which is a concept foreign to local law. Instead, we implement the shtar ’hov. This is a promissory note, a debt recognition signed by the tenant and their arev. This document does not represent an amount paid at signing, but an enforceable promise of payment. In case of non-payment, the shtar ’hov allows for faster collection procedures through the bank or the guarantor.

We distinguish between payment guarantees and security deposits. A security deposit is a sum of money paid to the landlord to cover potential physical damage. It cannot be used to offset unpaid rent unless the contract explicitly provides for it. The shtar ’hov, however, directly targets the rental debt. We verify the drafting of these documents to ensure they comply with local customs and are not invalidated by a court. This rigor in drafting securities is the foundation of seamless management.

Documents regarding apartment condition and mamad security

To protect the condition of the property, we recommend hiring a professional to perform a bedek bayit before the tenant moves in. This technical inspection report records the operating condition of critical equipment. We specifically check the mazgan (air conditioner) and the doud shemesh (solar water heater). A defective doud shemesh can cause significant structural damage if the water is not heated or if the system leaks. The inspection documents the initial state to avoid disputes when the tenant moves out.

The inventory must include the secure room, the mamad. We list the condition of the reinforced doors, locking systems, and the room’s sealing. The mamad is a major structural and security element in Israel; its condition must be indisputable. We also compile an exhaustive list of keys and access points: building entry badges, parking remotes, and mailbox keys. This document, signed by both parties upon the handover of keys, serves as proof that access means to the housing have been provided.

Allocation of charges: arnona and vaad bayit

The lease must precisely define who pays what to avoid unpaid charges that could impact the landlord. We request the latest municipal tax notice to identify the amount of the arnona. The arnona is a residential tax paid to the municipality and, as a general rule, it is the responsibility of the tenant. We verify that the tenant has acknowledged their obligation for direct payment to the municipality. A failure to pay arnona can lead to liens on the property, even if the landlord is not the tenant.

Regarding condominium charges, the vaad bayit, we verify the monthly fee amount and the payment frequency. We specify in the lease whether these fees are included in the rent or paid separately by the tenant. Finally, we verify the procedures for transferring utility meters. The tenant must provide proof of ownership change for water and electricity. We request documentation showing the closure of the previous occupant’s accounts and the opening of new accounts in the name of the current tenant to ensure bills reach the right person.

Management of property documents and tax status

For the lease to be enforceable, the landlord must prove ownership. We request an extract from the tabou, the land registry, to confirm that the signer holds the rights to the apartment. This prevents fraud or signatures by individuals with no title to the property. If the property is part of an ongoing inheritance process, we require the tsav yerusha, the succession order issued by the family court, to validate the legitimacy of the person signing the lease on behalf of the estate.

Document management also includes preparing information for the reshut ha-misim. The owner must declare rental income for the calculation of mas hachnasa (income tax). We collect the necessary documents to justify deductible expenses, which facilitates the annual tax filing. We also monitor the impact of rental income on mas shevach (capital gains tax) during the future resale of the property. Rigorous documentation from the moment the lease is signed is the only way to ensure healthy and transparent tax management.

Transfer file in case of succession or change of regime

Property management can be interrupted by an unforeseen event, such as the death of the owner. In this case, the current lease remains valid, but the management of documents changes. If a tzava’a (will) exists, it must be produced to identify the new beneficiaries. If the succession procedure is ongoing, we work with the heirs based on the tsav yerusha. This phase is delicate and requires close coordination with estate lawyers to avoid blocking rental management. We handle Signature of heirs for rental management in Israel with particular attention to the validity of each member of the estate’s signature.

For owners residing abroad, we use power of attorney documents for the signing of deeds. These powers of attorney must comply with Israeli law and are often certified to be valid before local institutions. We manage the continuity of the lease, particularly during the stage of Renewing a lease in Israel, even if the ownership structure has changed. The transfer of documents between former and new owners is a procedure we oversee to avoid any interruption in payments or management of building services.

Once the lease is signed and the documents are verified, operational management begins. The manager receives the keys and ensures the handover of access to the tenant. In the event of a technical problem, such as a water leak on a Friday night or a mazgan failure, the manager intervenes or mandates a professional. We monitor the payments of arnona and vaad bayit.
