The Tenant Must Vacate for the Buyer: Lease Termination in Israel

Getting a tenant to vacate an apartment in Israel to allow a buyer to move in relies on strict adherence to lease clauses and financial security through the shtar ‘hov. Unlike the US, where tenant protections can be rigid, Israeli law permits early termination if the contract allows it, but requires undeniable written proof of the request for personal occupancy. You must manage this transition by isolating debts, verifying community fees, and preparing the unit for the buyer’s entry, leaving no ambiguity regarding the property condition.

Termination Notice: The Specific Clause in Israeli Law

In Israel, tenant stability depends less on statutory law and more on the signed contract. Before acting, review your lease. Most contracts include a clause for early termination for personal occupancy. This clause is the foundation of your request. Without it, the tenant can challenge the legitimacy of your request in court, especially if they prove you already own another home in Israel or that the buyer is a close relative who will not actually occupy the apartment.

Clearly distinguish between two situations: termination for you or your family to occupy the unit, and termination related to the sale. Notice periods may vary based on local case law and the exact terms of the contract. Here, the contractual agreement takes precedence. If the contract is silent on termination for occupancy, the process becomes longer and riskier.

Formalize your request in writing. Use certified mail with a return receipt or the official digital platform if the contract permits. The tenant’s address must be the one listed in the contract. This proof of receipt is crucial. If the tenant refuses to leave, you take the matter to court. The judge will examine whether your intention to occupy the unit is genuine and serious. A false declaration of personal occupancy can void the termination and expose you to damages. Verify the consistency of your family and asset situation before sending this letter. We verify the presence of the specific clause in the contract and the consistency of your personal occupancy file before any notification.

  • Verify the presence of an exit clause or early termination clause in the contract, unlike US law where notice periods are often statutory and rigid.
  • Distinguish between termination by the owner for personal occupancy and termination for sale, which follow different timelines according to local case law.
  • Formalize the request in writing via the digital platform or certified mail, specifying the tenant’s address to avoid disputes over receipt.
  • Understand that the tenant can challenge the legitimacy of the occupancy (e.g., if you already own a home in Israel) in court.

The shtar ‘hov and Securing the Departure

The shtar ‘hov is a central legal instrument in Israel for securing a tenant’s departure. This promissory note, signed by the tenant and their arev (guarantor), attests to potential debts. No money is exchanged at the time of signing. It is a civil acknowledgment of debt. If the tenant leaves behind unpaid rent, fees, or unrepaired damages, this document allows you to initiate forced execution proceedings without having to prove the existence of the debt in a lower court, as the debt is already acknowledged in writing.

This document is not a bank guarantee. It does not automatically cover material damage unless the amount is specified. It covers sums due under the lease. Negotiate the exact amount of outstanding sums before handing over the keys. List unpaid rents, vaad bayit (condo fees), and utility costs. Once the amount is settled, the tenant and the guarantor sign the shtar ‘hov. Keep the original. Do not return it until the unit is vacated and the debts are paid. If the tenant refuses to sign, you cannot force them, but you can withhold the bank guarantee (if one exists) or initiate proceedings to recover the sums due. We draft the shtar ‘hov, detailing the outstanding sums and verifying the guarantor’s solvency before signing.

  • Require the signature of the shtar ‘hov by the tenant and their arev before handing over the keys, a document that attests to potential debts.
  • Clarify that this promissory note is not a bank guarantee but a civil acknowledgment of debt, enforceable in case of non-payment of arrears.
  • Negotiate the exact amount of outstanding sums (rent, vaad bayit, utility fees) to avoid future disputes.
  • Keep a signed and dated copy, with the original document remaining in your hands until the unit is fully vacated.

Key Handover and Joint Inspection Report

The move-out inspection is a technical document, not a formality. In Israel, there is no standard « utility check » like in the US. However, courts favor dated visual evidence. Organize a move-out visit with the tenant. Inspect every room. Note the condition of walls, floors, tiles, and equipment. Pay attention to specific elements: the mamad (safe room) and the doud shemesh (solar water heater). These equipment items are costly to replace. A crack in the mamad or a malfunctioning water heater must be noted and photographed.

Photograph every anomaly. The date of the photo must be visible. Israeli law assigns great value to dated digital evidence. Sign a move-out report distinct from the key handover. This report lists any damages and required repairs. The key handover should only occur after the signature of this report and, if debts remain, after the signature of the shtar ‘hov. If the tenant refuses to sign the report, invite a building professional (bedek bayit) to document the condition. This professional drafts a report that serves as evidence in case of dispute. We organize the move-out visit with a technician to document the condition of the mamad and technical installations, and we establish the joint report.

  • Organize a move-out visit with the tenant to document the condition of walls, floors, and equipment, particularly the mamad and doud shemesh.
  • Photograph every room and every anomaly, specifying the date, as Israeli law favors dated visual evidence in disputes.
  • Sign a move-out report listing any damages, distinct from the simple key handover.
  • Hand over the keys only against the signature of the report and the shtar ‘hov if debts remain.

Settling vaad bayit and arnona

Condo fees (vaad bayit) and the municipal residence tax (arnona) are expense items that the tenant must settle before leaving. Contact the building association to obtain the statement of current fees and voted works. The tenant must have paid their share up to the departure date. Verify the arnona statement with the Netanya municipality or your local municipality. The municipality will send you a statement indicating paid and unpaid months.

Crucial point: the owner remains jointly liable for arnona payments to the municipality. Even if the tenant has left and not paid, the municipality will claim the tax from you. You will then have to recover the sums from the tenant. This is where the shtar ‘hov becomes useful. If you do not have a shtar ‘hov covering the arnona, you must initiate proceedings to recover the unpaid amounts. Obtain a certificate of regularity of fees from the association before initiating any legal proceedings against the tenant. This certificate proves that you did everything to regularize the situation. We contact the association and the municipality to obtain vaad bayit and arnona statements, and we verify the tenant’s solvency on these items before the key handover.

  • Verify with the condo association if any work invoices or current fees are unpaid by the tenant.
  • Request the arnona (municipal tax) statement from the Netanya municipality or your local municipality, showing payments made up to the departure date.
  • Note: The owner remains jointly liable for arnona payments to the municipality, even if the tenant has left.
  • Obtain a certificate of regularity of fees before initiating any legal proceedings against the tenant.

Utilities and Subscriptions: Cutting Off Meters

The ownership of water, electricity, and gas meters must be transferred to your name or cut off. Never leave subscriptions in the tenant’s name after their departure. If the tenant does not pay their final bill, the utility company may bill you for the arrears if you have not reported the change of ownership. Contact the electricity company and the water authority to transfer ownership or close the meters if the apartment remains vacant before the buyer’s entry.

Check the condition of security and air conditioning systems. The mazgan (air conditioner) and alarms must be functional. If the tenant illegally disabled the alarm system or damaged the mazgan, this must be noted in the move-out report. Perform a final meter reading in the presence of the tenant. If they refuse, have the reading documented by a professional. This final reading is the basis for calculating the last utility fees. In Israel, cutting off meters is the owner’s responsibility. If you forget to turn off the water, leaks can damage the apartment and the floor below. We handle the transfer of water and electricity meter ownership and verify the proper functioning of the mazgan and security systems before the key handover.

  • Contact the electricity and water companies to transfer meter ownership to your name, or close them if the apartment remains vacant.
  • Do not leave subscriptions in the tenant’s name after their departure, as you would be responsible for future arrears in case of failure to cut off services.
  • Verify that the mazgan (air conditioning) and security systems have not been illegally disabled during the move-out.
  • Perform a final meter reading in the presence of the tenant or by a professional if the tenant refuses the owner’s presence.

Disputes: Filing with the Family Court

If the tenant refuses to leave after the notice period expires, you must file with the court. In Israel, lease disputes are generally handled by the Family Court or the District Court, depending on the value of the case. Present the judge with proof of the sent notice, the move-out report, and unpaid debts. The judge will examine the legitimacy of your occupancy request. If your file is solid, the court will order eviction.

The physical execution of the eviction is done by bailiffs, not by you. You cannot change the locks yourself if the tenant is still in the unit. This is an illegal act that can expose you to criminal prosecution. In case of unjustified retention of the apartment, request damages for illegal occupancy. These damages are calculated based on the monthly rent for the period of delay. If the tenant has debts, the court can order the seizure of their assets. If you are in the process of selling, this procedure can delay the signing of the notarial deed. We prepare the dispute file with proof of the notice and debts, and we represent the owner before the Family Court to obtain the eviction order.

  • If the tenant refuses to leave, file with the Family Court (or District Court depending on value) to obtain an eviction order.
  • Present proof of the sent notice, the move-out report, and unpaid debts to the judge.
  • The court can order eviction, but the physical execution is done by bailiffs, not by the owner.
  • In case of unjustified retention of the apartment, request damages for illegal occupancy, calculated based on the monthly rent.

Preparing for the Buyer’s Occupancy

Once the tenant has left, the apartment must be ready for the buyer. This phase is often neglected. The buyer expects a habitable home. Verify that the vaad bayit are up to date, as the buyer will take on future fees. If repair work is necessary due to tenant damage, do it before handing over the keys to the buyer. A dirty or damaged apartment can lead to a price reduction or a post-sale dispute.

Ensure a technical transition. The mamad must be secure. The doud shemesh must function. The meters must be in the buyer’s name. If the buyer is an English-speaking resident in the US, they will need a local point of contact to manage any post-occupancy issues. We offer the buyer our property management to ensure maintenance and fee management after their entry. If the tenant refused to leave and you had to file with the court, the procedure can take time. In this case, inform the buyer of the situation. If the buyer is already the tenant of the apartment you are selling, consult our article on Selling an apartment to a tenant: the notice in Israel to understand the specifics of this transaction. If the tenant has the keys but no longer wants to leave, the situation is more complex. Consult our article Tenant has the keys but no longer wants to leave in Israel: the law to know your remedies. We organize the key handover to the buyer with a joint inspection report and a transfer of utility subscriptions.

  • Ensure a technical transition: verify the mamad, the doud shemesh, and the meters.
  • Make necessary repairs due to tenant damage before handing over the keys to the buyer.
  • Offer the buyer property management to ensure maintenance and fee management after their entry.
  • Inform the buyer of the situation if the eviction procedure is ongoing.
